Mercedes Bluetec diesel settlement. Not being paid?

After dealing with this lawsuit for years, now I'm being told by JND holdings the bluetec settlement administrator that I'm not getting a settlement check. I have proof I provided everything needed and up until 2 weeks ago we were still being told we had a check arriving " any day now". After I posted a complaint on the BBB website about the delay, now they say I'm entitled to nothing.
I don't need to describe the details here as I know the direction I need to go. Question is does anyone else believe they should have been part of the settlement but were denied for any reason? I can see if there are any similarities before I contact the court regarding oversight on a mult-million $ settlement.

It's not the money I'm concerned about. It's about how I was treated. I've been a multiple Mercedes owner for 23 years for all that matters.

-Bluetec settlement had original deadline on June 30,2022, what was eventually extended to December 30,2022
It required AEM modification to start and was followed with 4-years warranty and up to $3600 checks
-the settlement was carried by law firm, where Shelby-1 of the associates was really good in responding to questions about status. Now it is water under the bridge.
-this year MB USA started "Direct Cash Program" who seems to be following the settlement rules, but is handled by different corporation.
-AEM has no expiration date.

I just reached out to the attorney that handled the suit, waiting for answer on where my previous owner check s are ??

2 sprinters and a s350 and still nothing

In a previous inquiry last year they told me they've received my applications and will reach out if further information is required.

Hi all,

After multiple attempts to know the status of my claim I was told this past month mine was denied. I’m an attorney and highly doubt I did not complete the claim properly and I never received any communication from them about and deficiency until now. They say I did not sign the release which I obviously did. I don’t feel like I will let this one slide as I know administrators abuse their discretion often, and regardless of my time per hour being worth more than the potential check.

i received an email saying that my claim is approved and that they will send an owner check in July 2023
yet nothing
is there any legal way to reach these people or is there any legal way to process these further? also same questo for hapaschold@aol.com
please let me know if yyou have any info how to proceed

Same thing here. I submitted claim on time along with all documentation. Received the SUCCESS notification. When I followed up, I was advised I was part of the claim. Then I received the letter below. Note that it says that decision is final, non-appealable and no reviews will be made. Is that even legal? They say my claim did not meet the requirements of paragraph 2.74 of the settlement which says:

2.74 “Valid Claim” means a Claim that is accurate, truthful and complete, executed by or on behalf of a Settlement Class Member, and submitted to the Claims Administrator by or on behalf of a Settlement Class Member by the applicable claims deadline. A Valid Claim must include all required documentation, including, for Eligible Current Owners/Lessees, proof that the Field Measure has been installed in their Eligible Vehicle by an Authorized Service Provider (e.g., by repair order).
We traded our GLK through the same dealer we bought it from. All documentation was supplied.

Is there anything we can do about this? Who do we contact?

I still own three other Mercedes, but this leaves bad taste.

I own a GL350 BlueTec and submitted a claim since last year but only heard back this year June when they sent a Notice of Deficient Claim dated June 27, 2023. I immediatley provided the requested documents via email, which they acknowledged on July 21, 2023. I haven't heard anything eversince even though i sent two follow up emails. The website says the deadline for claims was May 1, 2023 so there are no outstandings.

It seems too convenient that they waited until after this deadline to ask me for additional documents. I'm not sure what to do at this point as i feel cheated. Any advice please..... Thanks!

MBGraham - you are in Canada, so different settlement.
This thread is (was?) about non-payment in Canada by JND holdings the Bluetec settlement administrator (who it seems are a US company) . It is confusing, because some of the posters including the OP have US flags next to their names!

For those wanting to contact JND, their email address in Seattle is info@jndla.com. They also have (or had) a Vancouver office, but emails to them just resulted in a canned auto response.

Something is fishy when so many of us are told our claims did not meet with the requirements. Yet when we made them they were and we received a SUCCESS email.

Better Business Bureau have handled numerous complaints against JND have handled class action settlements. It seems they are disallowing claims because there was not a signed release. However, the claim application process was largely on-line. They never sent any documents by mail for signature. Basically it seems this company may just be incompetent or perhaps dishonest? Who can say.

Anyone else had any luck having their declined Claim reviewed? We have just been stonewalled by JND.

Our claim was accepted on Jan 8, 2002. Follow ups only said to be patient. Then on Nov 13, 2023 we received the letter denying our claim. No specific explanation even after we contacted them on Nov 23rd. So basically we made a claim which was accepted, were told to be patient while waiting. After 22 month our claim is denied with no option to review. This despite us providing all the documentation required.

I later checked with MB Canada, and the new owner (who must have bought my traded GLK) has had the modification done by a MBCANADA dealer. This would mean that the new owner was part of the class action and compensated. Yet for same vehicle, as original owner, my claim was denied despite it being on time and submission declared a success by JND (class action administrators)?

The amount previous owners like myself are due is not great - C$835 I believe, but there is a principle here and in one way or another, I want JND to be accountable.

I made two claims in 2021 (for two vehicles which I no longer owned) and one was paid out pretty early in the process, I am going to say in February of 2022. The other claim never got paid and no responses to multiple emails and voicemails were ever received either.

The claims administrator, JND, simply dropped the ball and so after seeing how many people were given the same treatment I filed a small claims case against them in August of 2023 and that sure got their attention. I was contacted with an obnoxious threat to have me withdraw the case "in order to spare me any additional expense"...no thanks.

Finally, as the court set the date they would have to start incurring costs to file attend a hearing I was contacted by an attorney there who tried to tell me my claim was incomplete (lacked a bill of sale proving I sold one of the vehicles) and since it wasn't included the claim was denied and now it is too late since the case is now closed.

Sorry, first of all they never said anything anywhere about requiring anything like that plus I had an email from 2022 when they said the claim was under review and if they needed anything else they would contact me and that was the last contact I had. After a bit of back and forth they finally agreed to pay me the full amount due PLUS filing fees and I settled the case. I don't think I ever would have seen a cent without resorting to suing them. Fortunately in my state filing a small claims case online is fast and easy. If you saved all of your documentation and correspondence you can win.

Thanks for that info. It provides a clear picture of just who we are dealing with. We could go to small claims in Ontario, Canada. We have our documentation. It will initially cost more than it's worth, but I am sufficiently annoyed that I may just go there. In the mean time, I have several other avenues that I will pursue.

In US the settlement was handled by law firm and as I mentioned, the Shelby from the firm was very responsive to the point that I never heard about somebody being denied the payment.
As for Bluetec remorse, I collected $14,000 from the settlement, when only 1 Bluetec cost me more than the amount.

That was one thing that was unfair. You bought cheap high mileage cars and received that high level of compensation. Purchasers of new vehicles like myself, who sold or traded them would only receive a pittance. I lost about $30,000 when I traded my GLK that had only done 33k miles after 5 years. I should have later received C$835 from the class action. Small consolation if I had received it :( (I am still negotiating with JND)

The administrator of both US and Canadian class actions was JND Legal. They handled evaluation of claims and distribution of payments. Other law firms initially acted on behalf of class-actions and may have had some influence over the administrators if something went wrong.

jokes aside, I don't think US law firm could handle Canadian settlement. Maybe they have different offices?
They just had a box office in Vancouver. I just spoke to the VP in charge of our settlement in Seattle and she tells me they are going to send me a cheque! Hopefully it will happen this time!

I would at least contact the class action administrators. I believe in US same as in Canada - JND Legal. I dealt with their Seattle office. Info@jndla.com. They have web site and it list emails of their principals. If all else fails, BBB may prompt them for an answer as to why you were not compensated. Good Luck.

Same exact thing happened to me. I have a GL350 and put in my claim BEFORE getting the repair done and they said send them the evidence of the repair when completed. I did so, now they are saying I did not prove ownership and sign a release form, which I did do. Typical law firm class action. They jack up the claim as much as possible with our help then drag it out without distributing the funds.

Just got off the phone with a Tom Healy who returned my call. He said he works with the administrator. Claimed our documentation did not provide the VIn when clearly it did. Could not give me the name of his supervisor who would have answers and states any money awarded would have gone to a non-profit but could not provide the name of the non-profit. When asked about any proof of communication from JND regarding claim status. Could not speak to it! Seems very unprofessional and self serving to me!!
