i think i have a lemon! c240

has anyone else had any of the following problems w/their car:<br> <br> -weakened transmission power(my car only has 5k miles)<br> -door lock problems (my back right door won't open from the exterior, only interior)<br> -MAJOR squeaky brakes<br> -brief periods of 'shakes' when my automatic car shifts gears<br> -headlight problems (left headlight ALWAYS stays on even when i turn the lights off; and the left headlight is much brighter than the left one when i turn both on..uneven headlight intensity)<br> <br> help! i have a broken car =( my car is so brand new but i'm already having so many problem..<br> <br> how can i follow through w/a 'lemon' claim.. possible? should i even? anyone know more info about the requirements or procedure?

Check the lemon laws for your state. Doesn't sound like it would qualify. How many days has it been in the shop? How many times for the same thing? The problem generaly has to impact the safefy of value of the car. Dumb question, but is there any chance that you are in winter mode?

If the dealer is unable to fix/repair the vehicle you have a lemon claim. Remember that to start the process you have to notify MBZA of your difficulty. See the other posts on the board which provide a great deal of info on Lemon Claims.
The following is an excellent 'Lemon' synopsis posted by 'michala'.<br> <br> LEMON LAW<br> The 'Lemon Law' is simply a term that is used to cover a body of laws that protect the consumer from goods sold that are defective and under warranty and to provide a means to recover any loss one may have incurred due to the defective product. <br> The 'Magnusson-Moss Warranty Act' is the federal 'lemon law' act and in conjunction with this all but 2 states have enacted 'lemon laws' of their own. These laws very from state to state but they all hold similar things in common. They are as follows: <br> 1. They require the manufacture of the vehicle not the dealer to remedy the problem. The dealer may have the authority to do the repairs but the ultimate responsibility for the warranty falls on the manufacturer. (Unless of course the warranty was issued by the dealer which occurs at times with used vehicles). <br> 2. The defect must substantially impair the use, value, or safety of the vehicle and the manufacture must have been given sufficient time to remedy the problem. If the problem is not remedied the consumer has a right to a refund or a replacement. <br> 3. The question of what is sufficient time to repair a problem or defect varies somewhat but in general it's as follows: <br> a.) If the problem or defect involves a serious safety issue such as the brakes or the steering then the manufacture is given one (1) opportunity to fix the problem. <br> b.) If the problem is a safety issue but not serious then the manufacture is given two (2) attempts to repair. <br> c.) If the defect is not directly safety related then the manufacture is given three (3) or four (4) attempts to fix the problem depending on the state. <br> At issue here is the warranty! If a car is purchased without a warranty then the 'lemon law' does not apply per se. Other laws may be applicable such as 'breach of contract' which goes beyond our scope of discussion and one is encouraged to consult with their attorney on such an issue. <br> Each state has enacted different guidelines as to the period of time within which a vehicle is 'presumed' to be 'lemon'.(You can take a look at the 'State Summary' page on this site for the guidelines in your particular area.) <br> As an example in California the state 'lemon law' is the Song Beverly Consumer Warranty Act. It is 'presumed' a vehicle is a 'lemon' if a problem is addressed within the first 12,000 miles or 12 months of the vehicle purchase. In this case its up to the manufacture to prove that the vehicle is not a 'lemon'. If a vehicle defect is not addressed within this time period then the burden of proof falls on the consumer. The criteria is not whether the vehicle has been brought in three or four times during the first 12 months or 12,000 miles but only if the problem has been addressed even once during that period. <br> <br> <br> Each states 'lemon laws' regarding the 'coverage period' will vary. There may be factors in an individuals case that falls outside of the covered period. Ok, first i will say this over and over as i have in the past, they dont make cars like they use to. A benz still has the name, the class, the power look, and the safety, but not the relialbilty as it had back in the 70s and 80s. Now to address one of your issues about the left light, when you turn your lights off u seem to be twisting the light nob all the way to the left. Thats wrong, it should be twisted to the middle. U see the car had a feature where you can keep either the left or the right light on all night with out using up your batery much. Its a safety issue if you park on a hill or on a curb so cars can see you while your car is parked. You will not get a dead battery. So go back and test this out, turn all the way to the left and you will see the left one on, then turn all the way to the right and the right one will be on. This is not a problem with the car, only an option. Its there because in europe they have steep roads and curves and people park on the side. Now, for the rest, u cannt claim a lemmon law for just having problems, u need to take your car in. I think your brakes squeeking can be fixed realy easily and the transmition issue well i have heard people have that problem and there is a fix. Dont get me wrong I would be just as pissed off as you are but i also think it can be fixed. Please let us know how it turns up for you

I always turn my light knob to the middle- automatic position. trust me, i have tried moving my light nob in every position and this problem remains. but even during the day when i'm driving, the left light remains on. and at night, the left light's intensity is about 50% brighter.. i don't think this is a mercedes option.... it's in the dealership now so we'll see what happens!<br> <br> the fact that i have less than 5,000 miles and more problems then my friend's honda civic really pisses me off.

Ok now what u have seems to be a problem. I thought u were not turning it to the middle. Well, if u think that pissed you off then check this out, I have a 2002 C 240 and the first week not even 300 miles i pull up to a gas station and my car would not start. They had to tow it in, then order a part for the ignition system from germany. That has been fixed now and everything is fine but i was beyond pissed off. Hear is my opinion on cars, Benz and BMW are bought for status,class,technology and saftey, japaneese is bought for durability. The sad part is that Benz use to be durable but not any more. Too many gadgets causes problems. So it depends what you want out of a car. U want from A to B then japaneese, u want to show off alittle then the Benz. Any way i put in my 2 cents on my dispointments and plus with benz. Hope some of the damn rolex watch wearing armani suits dressing excutives read these forums.
