Was there ever a recall or no cost repair offered up by Mercedes for this problem? I think the seats on my '01 ML430 get a little too warm in spots. It may not be dangerous yet, but I think the element is on it's way out.

I don't know of any but then again I really do think mine was do to the accident. I certainly remember the sensation of that seat though.

It's been a fairly common problem on the MLs though, and the fact that it can actually burn a braindead who doesn't have the sense to turn the button to the off position should have lawyers licking their chops. I'd like to get mine fixed for free, even though the warranty went away years ago.

Have you asked your SA or the dealership if there was ever any sort of bulitten on it? It could be that there was and you might be able to get them to cover it. I am a big fan of "you never know if you never ask".

my dealer programmed the seat to the extent that almost no heat is coming from the seat anymore.
