Here you are.I got the AEM performed in april, now after about 5000 miles the check engine light came on with the car going into the limp mode...after I restart the car the car comes out of limp mode but check engine stays...and then after certain RPM rise it goes back into limp mode....the code is P0299, seems like turbo charger or the actuator.....I called the dealer, the receptionist says they will charge me $235 an hour......even for diagnostics, then if this is a fault of AEM upgrade then they will cover it....upon my mentioning of the class action law suit she said bring all the documents that says turbo is covered on the date of appointment which is on this monday November 8th....I also have timing chain rattling in the cold start.....Can some one please share the document that specifically says that turbo and timing chain are covered??? will really appreciate it......
Is this also a Canadian warranty offered by the dealer? Here you are.
Turbocharged is and timing Chan is in the extension of 40k miles warranty but only if the come “”” to prove of it going bad due to the AME upgrade you took it in forI got the AEM performed in april, now after about 5000 miles the check engine light came on with the car going into the limp mode...after I restart the car the car comes out of limp mode but check engine stays...and then after certain RPM rise it goes back into limp mode....the code is P0299, seems like turbo charger or the actuator.....I called the dealer, the receptionist says they will charge me $235 an hour......even for diagnostics, then if this is a fault of AEM upgrade then they will cover it....upon my mentioning of the class action law suit she said bring all the documents that says turbo is covered on the date of appointment which is on this monday November 8th....I also have timing chain rattling in the cold start.....Can some one please share the document that specifically says that turbo and timing chain are covered??? will really appreciate it......
There is a “lemon law” clause in the class action settlement where Mercedes is required to repurchase your car if it is not driveable for 30 days within 18 months after the bluetec emissions modification. Furthermore, Mercedes requires dealers to provide a loaner during extended emission warranty repairs. If you need further help please let me know.Had the emissions modification done about a week ago on 2014 ML 350 BlueTec. ERG valve was giving check engine codes but car was drivable. Today had to have car towed to dealer after car stalled while driving on a busy highway. EGR valve is faulty and is stuck in open mode. Mechanic said car cannot be driven until part is replace. Dealer cannot locate the part anywhere, on back order and may not be available for 3 month. That leaves me without a vehicle for 3 months!! Does anyone know where I can find this part? I have called Mercedes US headquarters but still no part. Several dealers in the US have the part but will not release it to my local dealer knowing new parts are not available. Buying it off eBay may void the 2 year emissions warranty—no one can give me a straight answer on this. Plus I would have to cover the total cost. (If Mercedes had the part, cost would be covered by warranty.) I am very frustrated. Any guidance will be much appreciated. Thanks.
The timing chain is covered by the warranty regardless of the reason it fails (or stretches too much).Turbocharged is and timing Chan is in the extension of 40k miles warranty but only if the come “”” to prove of it going bad due to the AME upgrade you took it in for
I might qualify for that buy back. How much are they providing? I've had several issues since the modifications and at one point they could not determine where the fault for the AdBlue shut down was coming from. They had it in the shop for about a month (no loaner for that time but I was working from home and had extra cars around so didn't need one -- other visits have all included a loaner -- even got an EQS for long weekend). There is a “lemon law” clause in the class action settlement where Mercedes is required to repurchase your car if it is not driveable for 30 days within 18 months after the bluetec emissions modification. Hi Boris, the buyback amount isn’t specified…it says MB must “repurchase the car”. I Interpret that to mean original MSRP because it says ”repurchase”, not “purchase”. Absolute worst case a judge would give you book value. Was your car driveable while it had the problems? I’m happy to help with the contact information to get you what you deserve from MBUSA. The class action lawyer got paid 80 million, and they have to help free of charge for certain situations.I might qualify for that buy back. How much are they providing? No check yet from the law firm doing the suit.
Thanks,

Here's what I found on the Mercedes Settlement Agreement (found on the "Documents" page of the settlement website):Hi Boris, the buyback amount isn’t specified…it says MB must “repurchase the car”. When did you submit your claim for the class action? You should have received your check by now.
Hi Boris,Here's what I found on the Mercedes Settlement Agreement (found on the "Documents" page of the settlement website):
"Defendants will offer to repurchase the Subject Vehicle for an amount equal to the value of the vehicle according to Manheim Market Report."
From what I can find out, the Mannheim Market Report is a dealer auction valuation tool -- so likely a pretty low price -- especially given them my ML250 has 226000 miles on it.
