Recently, received a mail from the dealer I bought the car from, stating that mercedes is performing a complimentary Approved Emissions Modification. Does anyone have this info? Also, any cash claim available with it, etc?

There's a lot of discussion in the diesel forum here. There's a few thousand dollars for owners/former owners of Mercedes diesel cars that have "Bluetec". To get that you have to submit a claim by a certain date in mid July if you are a previous owner, or have the AEM done and submit a claim by October if you are a current owner. Read the fine print, as you give up certain legal rights if you accept the settlement by submitting a claim, so consult an actual legal expert if you don't understand what is written in your notice. Also I Am Not A Lawyer, and this isn't legal advice.

Had the AEM done on my 2014 ML BlueTec a few weeks ago - new cat and a couple of other mods. Key is the 48 month extended warranty - virtually anything that might go wrong with engine or emissions is now covered. MPG went down a little but not significant. Being the second owner, I am expecting approximately $2700 some time later this year. Good luck!

I got the AEM performed in april, now after about 5000 miles the check engine light came on with the car going into the limp mode...after I restart the car the car comes out of limp mode but check engine stays...and then after certain RPM rise it goes back into limp mode....the code is P0299, seems like turbo charger or the actuator.....I called the dealer, the receptionist says they will charge me $235 an hour......even for diagnostics, then if this is a fault of AEM upgrade then they will cover it....upon my mentioning of the class action law suit she said bring all the documents that says turbo is covered on the date of appointment which is on this monday November 8th....I also have timing chain rattling in the cold start.....Can some one please share the document that specifically says that turbo and timing chain are covered??? will really appreciate it......

So hers are the text messages I got from my dealer:

Tech found 3 different issues happening with your vehicle. They are still diagnosing it and checking to see if all or parts of it are covered under the warranty extension. Boost pressure lose is due to a bad charge air hose, there is also a broken egr pipe and then also the timing chain rattle. I'll know more tomorrow on the warranty coverage and get back to you. Thanks

And then this:

The specific codes are "16DA00 THE POSITIVE CONTROL DEVIATION DURING BOOST PRESSURE CONTROL IS TOO HIGH" and "150300 THE UPPER LIMIT VALUE OF COMPONENT HOT FILM MASS AIR FLOW SENSOR HAS BEEN EXCEEDED"

He will give me more updates tomorrow.

Did anyone had these repair work…

Had the emissions modification done about a week ago on 2014 ML 350 BlueTec. ERG valve was giving check engine codes but car was drivable. Today had to have car towed to dealer after car stalled while driving on a busy highway. EGR valve is faulty and is stuck in open mode. Mechanic said car cannot be driven until part is replace. Dealer cannot locate the part anywhere, on back order and may not be available for 3 month. That leaves me without a vehicle for 3 months!! Does anyone know where I can find this part? I have called Mercedes US headquarters but still no part. Several dealers in the US have the part but will not release it to my local dealer knowing new parts are not available. Buying it off eBay may void the 2 year emissions warranty—no one can give me a straight answer on this. Plus I would have to cover the total cost. (If Mercedes had the part, cost would be covered by warranty.) I am very frustrated. Any guidance will be much appreciated. Thanks.

Hi all.
I'm new here. I had the BlueTec work done last year, submitted paper work in class action suit in September, 2021, and received settlement check this week. I'm second owner, but apparently first owner never filed so I got the full amount: $3590.

I own 2 ML350bluetec 2014 and I am just going through a nightmare with this conversion. I got it done on one in Las Vegas in March However, I live in Chapala, Mexico so off I go home. After a 2500km drive the car is asking for blue-def. 20 liters later it is still asking and then goes into shut-down mode (10 engine starts left) I made it with 2 starts left back to Vegas. The fault was in the blue-def spray nozzle, which USA Mercedes does not supply in the kit for the ML's but does for the GLK's. The also are not asking and paying for the driving test, which would have shown trouble.
So I drove 5000km total to get it fixed . The car will also use now more blue-def and I see the mileage down by 10% at least
I just got home again and now have error codes po405, po404 and 2463.. 2463 was 2464 after driving 1000km but changed to 2463 by the time I got home.. There might be an ERG valve problem, but back-ordered for 3 month???
To add insult to injury, since my cars are now registered in Mexico, no settlement payments (~$3500)
I don't think I will do the second ML , they are entitled to the conversion by VIN numbers, don't care who owns it and where it is registered.
Last year I could have gotten one of those "defeater" on eBay, made in Russia, but their invasion shut this down, they can't ship and can't get paid. Anybody has some info on that?
I could find no information how to reset on my own the 10 starts left. Interestingly in Germany they do not shut the car down.
Anybody has had any experience with all this? I would appreciate helpful comments.

There is a “lemon law” clause in the class action settlement where Mercedes is required to repurchase your car if it is not driveable for 30 days within 18 months after the bluetec emissions modification. Furthermore, Mercedes requires dealers to provide a loaner during extended emission warranty repairs. If you need further help please let me know.

I might qualify for that buy back. How much are they providing? I've had several issues since the modifications and at one point they could not determine where the fault for the AdBlue shut down was coming from. They had it in the shop for about a month (no loaner for that time but I was working from home and had extra cars around so didn't need one -- other visits have all included a loaner -- even got an EQS for long weekend).

No check yet from the law firm doing the suit.

Thanks,

Boris

Hi Boris, the buyback amount isn’t specified…it says MB must “repurchase the car”. I Interpret that to mean original MSRP because it says ”repurchase”, not “purchase”. Absolute worst case a judge would give you book value. Was your car driveable while it had the problems? I’m happy to help with the contact information to get you what you deserve from MBUSA. The class action lawyer got paid 80 million, and they have to help free of charge for certain situations.

When did you submit your claim for the class action? You should have received your check by now.

Here's what I found on the Mercedes Settlement Agreement (found on the "Documents" page of the settlement website):

"Defendants will offer to repurchase the Subject Vehicle for an amount equal to the value of the vehicle according to Manheim Market Report."

From what I can find out, the Mannheim Market Report is a dealer auction valuation tool -- so likely a pretty low price -- especially given them my ML250 has 226000 miles on it.

Hi Boris,
The Manheim repurchase price applies if MB never provided the AEM and folks couldn’t register their car. But yes, MBUSA could argue that the Manheim value is what they owe for warranty failures even if the language doesn’t apply to the warranty section. I would argue that because the warranty repurchase is modeled after lemon laws, then repurchase is for MSRP because lemon laws require MSRP.
