03 ml350 ESP BAS light on stuck in park

Hello,
Proud owner here... well, I was for the length of the three times I used the damn thing. Last time I drove it everything was normal, no light on. I parked on my driveway for two weeks (we got lots of snow and very cold weather). Yesterday, cranked and started right up, press on the brake pedal and the esp bas light came up and the shifter would not move out of park.
Turned the steering left to right full lock, the light went out (this tells me my column steering sensor is ok). Stopped the engine, cranked again, as soon as I pressed the brake pedal the esp/bas light came on again. I could notice the rear brake lights illuminated...
What gives?
I guess I'll need a scan to really know. Are there any scanners which I could get to scan for these issues or I absolutely need to go to a dealer/indy?
If the car never moved can I blame it on humidity/corrosion on wires/connectors alone? maybe a bad esp relay or low voltage to the circuit because weak battery? (it did cranked very healthly).
I understand on my model year I do not have the brake pedal switch, it is instead a brake fluid pressure switch on the master cylinder. Can that one be bad and still have the rear brake lights working?
I can use the pen trick to unlock the shifter and maybe take the esp off. Can I drive like that around?

There should be a small hole you can place a screwdriver into for the transmission bypass switch. Press it down and it SHOULD allow you to move out of park. Not suggesting you do this as I don't know your issue - just providing the information.

I had the same issue when the vehicle was still under warranty. In fact 2 years into ownership. Dealer corrected the issue. According to the note written on the invoice, There was some kind of wiring that needs to be corrected. There was no component swap for the repair. I haven't have the issue since than.

heard that a low brake fluid can do that too (I found the brake pedal travel rather long and I know the rear rotors are under min (maybe worn pads too).
any scanner worth considdering?
is this my only option?

Post #21... one more thing too check (corrosion at the abs hydraulic controller under the washer fluid tank. my truck is in the specified VIN #'s)
will post back with the solution once I'll do all possible checks.
really wished these scanners would be more affordable...

Pen is stuck now!

I used the pen trick to get my transmission out of LOCK mode, now the car seems to work find but the pen is stuck! Seems like something is clamped down on it and I don't want to break anything by getting someone strong to yank it out! Any tips on this?

dunno what can bind it, but definately I would not want to break anything on this truck;-)
my rear rotors are under min, no ideea if this can cause my issue. will change soon.
in the meantime I will order the carsoft multiplexer to see what the code looks like. at least the damn thing is driveable.
got the epc/wis as well...

just a quick update.
I got the alpha bid multiplexer and finally been able to read the error codes. The were interrupted wires going to a BAS swich on the brake booster. Right at the connector.
Will post back details but beeing able to read the actual code is critical;-)
