After discussion with Prof Lou, we would like to sticky this separately temporarily, after modification and organization, we will put this under the transmission section of the sticky. This very post would be deleted too.

Maybe if we keep it separate as a FAQ so it'd be more apparent?

Today, I check the transmission fluid in my S500. Start engine, after over night, shift from P-R-D-R-P, go out stuck the dip stick, engine running, outside temp. 90F, assume fluid is little higher than 25C, but dip stick measured 53 mm. Take car out drive 30 miles, come back, set to park, with engine idling, push dip stick in, fluid level over the max mark by 20 mm. Use laser thermometer check fluid pan temp. 81.5C. What will happen to the transmission if I have been running the car for 3600 miles with over filling fluid ? My transmission fluid was replaced by dealer one year ago. Please advise.

Your transmission is overfilled by about 20 mm at both 25 deg C and 0 deg C. If you are concerned, then you can suck a little out of the dipstick.

Professor Lou, My car need state inspection sticker, I will go to the dealer and ask them to correct the fluid level with the state inspection job. But my major concern is the damage that has been done for the prolong incorrect fluid level. The E320 has transmission fluid change by the same dealer 2 years ago by different mechanic, after the fluid replacement, the transmission runs like new and very smooth. But the S500 has only improved very little. This suspicion make me have the courage to investigate the problem.

I would not worry. Both the 722.6 and 722.9 have built in mechanisms to deal with fluid overfill (preventing whipping and foaming). While it is not a good idea to over fill, I doubt there is any damage.

Thanks again for your expert opinion. It give me a peace of mind. I own an oil extractor from HFreight. I could have suck it out but I like the dealer to correct their job. I just replace my motor oil last week with the extractor. When I check the motor oil level in my E320, it is overfilled too. But I will let it go because I have to replace the oil in 1500 miles according to the FSS. I think all the leaking on the engine valve cover is resulted from the overfilled oil by the dealer.

Ya, dealers often dump in the amount listed in the "capacities". It is better to check with the dipstick (if the car has one). At one time, dealers were overfilling the M104 engines left and right (which caused leaks) and MB had to issue TSBs to reduce oil capacity and also advise that the optimum oil level is the mid-way between MIN and MAX. I have always try not to fill oil above that level in any engine. That means I do not pour in the quantity listed in capacities. On my M104, I use about 6.5 quarts. On my M112, I use slightly less than 8 quarts.

I took the car back to them today, they check the level and agreed that was 0.5 L too much and suck it out without charge after one year. Afterward, the transmission shifted batter. Actually, when they review my old invoice, they had flush the transmission with the MOC machine from California plus removed the filter and pan and repair the harness leak. That means the fluid in the converter is replaced. With the flush, the job is $100 more than the regular filter and fluid replacement. ($223). The MOC machine can flush motor oil, radiator fluid and power steering system. But I do not know those charges. Have you guy heard about it ?
