No parking brake warning.

Well I'm asking this for a buddy of mines who recently purchased a 1997 E320. He told me the previous owner had driven the car without pulling the parking brakes a few times. According to him the first time he drove it home he forgot to pull the parking brake as well (because of the lack of warning). He would like to know what the problems is.
I've test drove his car and I've noticed when I park the car and step on the parking brake the car shakes. (as in it doesn't feel parked, it moves forward and back, but the wheel does not move)

So I'm guessing his problem is why doesn't this car tell him that he did not pull his parking brakes anymore?

The way the system works on my models is, that you don't have any light when the parking brake is applied, but red warning sign will appear on the cluster once you start driving without releasing.

Yeah, thats what I think the problem is, lack of warning when the driver drives without release.

EDIT: Well I'd just called him and he saids that "the car doesn't show any warning when the parking brake isn't released"

EDIT2: This is actually my question. Is it true that all E320 (W210 and W211) leaks oil slowly? My 04 does it leaks a few drops a night.
