Black Plastic Engine Covering Fastener

I recently had my car serviced at any independent shop. They resolved the bad vacum line promptly, however when I checked air filter assembly I noticed that the black plastic engine piece that sits on top of the engine was slightly loose.

Upon further inspection I determined that the rear two 10m nuts were not there.

Question...? Isn't the black plastic engine covering supposed to be fastened by the two rear fasteners...?

The independent shop in Escondido, CA agreed to buy new replacement pieces from the dealer.

I'm going to pickup the parts this week, however I think I might look for another dealership alternative in Northern San Diego.

Has anyone tried Encinitas German Car repair, they always seem to have plenty of Benz' in their shop...
