Good not to feel left out. Last summer I pull off the LIE in Queens to get gas. I reach down to get my wallet out of my briefcase which is on the floor under the glove compartment. SNAP!!! I grazed the cup holder and out it popped with the coffee cup, two sugars and half and half. It all managed to find the slot in the gear shift and it fried the computer board. I was stranded.
The best part was that after talking to road side assistance for 30 minutes I was like.... "Isn’t there anything we can do to get this car moving? I mean this is a MB. I can't tell you how many JEEPS I have owned in my life that I have spilled shakes down the gear shift and it didn't even flinch". The guy says, "do you have a pen or pencil.... (yes).... stick it in the hole below the gear shift and try pulling it into gear. EUREKA! "Why were you holding back on that tip?" (silence) Now you have to drive home in first gear. Well, $1,400 later and I was up and running in all gears.
Should this have been covered in my warranty? I mean, it was like the equivalent of on tablespoon of fluid. The car should tolerate this... it's a Benz... right?!
Bottom line... that cup holder is should have been recalled if owner are dishing out $1400 plus for it tipping over so often. Are there any aftermarkets?

Sorry to hear about your cup holder problems. I'll try and cover a few of your questions:
The roadside assistance personnel may not have been holding back on any information. They may have thought you were more familiar with the owners manual. There is a section in the owner's manual entitled "Transmission selector lever, manually unlocking".
This is not covered under your warrantee. MB USA considers this to be operator error. The owners manual states "Caution Keep cup holder closed while traveling."
Legally, MB USA isn't obligated to recall the car. The NHTSA would have to order them.
Beginning with the 2001 model year, the design was modified to lessen the chance of damage occurring. I still don’t use the front cup holder. At any rate, there are aftermarket cup holders that can clip to the map pockets in the door.
Yep spilled Coffee in mine. It will just keep getting worst so the quicker you get it fixed the better. My mechanic at the time got the part a shifter control module unit from MB for @ $500+ and replaced it for @ $150. The Stealership wanted @ $1600. I personally think it a Manufacturer defect bcuz if you see like an '04 model they placed a cover over the shifter and moved the BS cup holder/spiller. I say Class Action against MB and that Bs design.

Marcus, can the TCM be dried out, refurbished, cleaned or whatever or is the unit trash once liquid hits it with power on? TIA
Fortunately, I have no experience in this area. Removing it, and taking it to a good hi-fi repair shop for a thorough cleaning certainly sounds like a viable option.
German cars have NO CUPHOLDERS...The Americans made the Cupshitholders. You spill your cruddywhatever on the electronics...Your the problem with your Me Me Me I'm the customer BS....I gotta vent on this...Sorry, but Cell phone ,drinking your $5latte(latte money spent on Crap) ...Pay attention to what da phuck you're doin'....
