This reads like good news but what exactly does this mean? Is this still pending in courts? Is this something that dealers would be aware of at this time? I guess my concerns are if all that passes how would the good folk out there know about it and does this press wire to all dealers if all goes through. I would love it as I'm sitting at 90k and it's a nice little warranty for us all whom have had reliable cars. It would also free up some nice cars many have looked past for purchase
It appears to mean that a California federal judge has worked with the "the class" and MBZ to reach a settlement:
The Mercedes class action settlement is for “all current and former owners and lesses of Mercedes-Benz branded automobiles equipped with M272 or M273 engines bearing serial numbers up to 2729..30 468993 or 2739 ..30088611, found in the Subject 2005 – 2007 Model Year Vehicles respectively (the ‘Subject Vehicles’), who purchased or leased their Subject Vehicles within the United States.”
According to the class action settlement agreement, Class Members will be reimbursed for repairs they had to fund to the tune of thousands of dollars due to the alleged engine defect as well as “future repairs for the allegedly defective parts at issue for the lesser of 10 years or 125,000 miles, subject to certain conditions and limitations.
“This extended coverage more than doubles the durational limit of MBUSA’s New Vehicle Warranty’s term of the lesser 4 years of 50,000 miles,” the class action settlement agreement explained.
The amount Class Members will receive will vary. Repairs not done at an authorized Mercedes dealer will result in a reimbursement up to $4,000. Mercedes will also cover the cost to repair future engine problems, which will also vary depending on the age of the car when the problems come to fruition. The reimbursement will be 100 percent, 70 percent or 37.5 percent of the cost of the repair.
Well that is good news, especially for those that have already had the issue and done the repair. I've been lucky so far...sitting at 97k without the issue surfacing. If it is going to happen in my car then it needs to happen soon (this year)....as we reach the 10yr mark next year (2016). The way I read the settlement, the closer your car is to 10yr/125kmiles, the less they pay...is that correct? so, if mine did happen they would be paying 37.5% of the repair...better than nothing I guess.
I guess the big question is will Mercedes provide a diagnosis review for cars that have not thrown codes, and if they find the wear and tear fix this issue. If this was the case I would gladly pay to have my car evaluated as a service check. I will be calling my SA and discussing this in the near future. I've been with him 10 years so I expect there is potential for this.
I also read this as we now have a 10 year 125k mile warranty for this problem. Meaning I could have 124k at the 10 year clip and be 100 percent refunded. The way I read it the lesser payouts would be for future as In 12 to 15 year up to 200k type of thing. I'll be honest my car with 92k or so is absolutely mint inside and out and never gave me a issue. I have sat in every new car there is, the entire Benz range. I really have my heart set on keeping my c350 to upwards of 200 plus miles. They are quite great cars in proper spec. I still love that I can select my points of interest on the move
Robert, I hope you are correct on the warranty extension being 100% up to 10yr/125k and then reduced from there... I plan on keeping mine also. I just haven't seen the details of the settlement yet.
So I read the criteria as no refund or reimbursement after 10years or 125K miles whichever is reached first. Am I interpreting this correctly? I sure hope not. My ML is at 9yrs and 138K miles, so does this qualify for the repairs and my balance shaft is out.
No, at 138K miles, yours would be beyond the 125K limit and thus not qualify for any relief under the class-action suit settlement. My advice is to follow the instructions and exclude yourself from the class. If yours fails, then see if you can find an attorney to handle filing your own suit.
so my 06 is at 99 on miles so i still have time the thing is does the repair needs to be done by mb dealer or can it be done by indy shop if so how much of the repair seems to be cover.??? thanks
The repair can be done anywhere, but you'll only get $1500 towards it (37.5% of $4K), assuming are still in the 10yr/125K mile limit. If your car has the symptoms (DTCs 1200/1208 = OBDII codes P0017/P0016) and you are still in the 10yr/125K mile range, then get it fixed now, or lose out on being able to claim that $1500 supplement. If you have no symptoms, then you may not have experience premature failure - only a small percentage of affected engines do.
