So I received my car from being shipped to NC from NY. Upon inspection of it I saw that the bands they used to secure my car through the rims rubbed the finish and some paint off of my rim. I contacted the shippers and they said in the contract it stated that rims are not covered. (which is true after reading over the contract once more) I'm going to state that the car was inproperly secured because upon delivery the straps were around the tires not the rims. Do you think i'll have a fighting chance? I want my rims replaced and I feel that they are liable for the damage because it was not there when the car was picked up, which is backed by the original inspection document.
if it is stated in the contract, chances are you have a very small window to win that one.
wifey is an attorney, so, written contracts are pretty much a done deal and very little chance to win the case.

Drop a claim against them. Take plenty of digital photographs.
You see; biscuit heads like that; jump on a computer and invent all sorts of
fancy words and they think those fancy words are irrevocable, like a Mountain
or the Moon.
Seems to me they were negligent in BASIC shipping standards.
Don't forget to file a complaint against everyone in NY so there business
record is tarnished. Better Business Bureau, Consumer Affairs, or anyone
else you can dream up.
So when other folks do a background check against the Shipper, their
unprofessional record will clearly show it's ugly head.

I'm crossing my fingers and hoping that this claim goes through & I plan on getting ///amg split spoke 18s. That would make my pain go away.
I really do like my rims and I was hoping this wouldn't of happened but with my luck something always does. I'm just glad the car was not dented.
I have yet to receive the claim form although they said they'd email it on Friday!

Check your local resources- you may do better in small claims court, which are often very consumer-oriented. Contact your local bar association for a lawyer who'll give you a consultation on the matter, one well-versed in consumer issues.
From your pictures, that damage appears to be more than a consumer might reasonably expect when allowing for shipping mishaps. That's where your prevailing would hinge- for the shipper, it'd be best if they just sawed the bottoms of the wheels and tires down to where they were flat, and would sit best on the trailer. After all, that's what it says they can do in that contract. At the same time, canvas strapping on finished aluminum would leave some burnishing that'd be on the order of slight curb scrapes, and that (although still distasteful) would have to be considered "reasonable" shipping damage.
And the question might be posed that if the manufacturer is able to haul thousands of these things across an ocean with no damage, why can't a shipper get one across a few states, with far fewer waves? Do they have some reason they can't use the same tie-downs the manufacturer does, instead of the quick, dirty and destructive method of using the wheels for a purpose they were never intended?

Well as for an update. I received the claim form and completed it. I have yet to submit it but would like to before the 4th of July holiday. I still need to take better pictures.
As for the performance of my car I noticed this morning my car was viberating unusually. The alignment is def off and sways severly to the right and I'm not sure if my balance has been affected as well. I just spent a good amount of money last month servicing my car and I'm quite upset.
This has not been the best experience. My father recommended that I drove the car myself but I didn't want to put those miles on the odm or sit through a 10 hour drive.

Those photos are horrible. Sorry.
Change your settings on your Digital Camera to
either the Green Dummy Setting, Landscape or Portrait.
If you have a Ruler, Place it on the offense and take the Photograph.
It helps.
Also; take four general shots of the Wheels and Rims.
Close up.
IMPORTANT. Drive your car so the offense is at the bottom or top.
Choose the position that injured your car and then take the photos.
What this does it helps the claims people to recognize, that all four marks
are exactly the same, further supporting your claim. A general picture also helps to see your rims, tires were not previously damaged.
