Thanks guys. I am bringing it in for 1000 mile free service. The passenger seat is just getting worse. it will not leave there without being fixed. Stay tuned. As for the tranny I am not happy with the shift from first to second. Lets see what they say.

Yay! first post ever for me. I just purchase a 08' ML550 a month back and I have the exact same problem with the transmission as yours. I wonder if all ML550's are like that? The service dealer told me that it's normal on the first 500 miles or so. The adaptive transmission with learn your driving habbits and smooth itself out eventually. I have about 388 miles on it so it's too early to tell, but it sucks driving like I am in a manual vehicle from 1st to 2nd. Good luck with your problem.
If you lightfoot it, it will shift very quickly for mpg. Try giving it at least 50% throttle. And drive it like that a lot. The transmission will calibrate your right foot and everything should be good.
I understand the tranmission is adaptive but to have to drive half throttle for it to learn is crazy. I have 1000 miles on mine now and is no better. I noticed that if you gradually increase pedal travel it does it badly. If you go right to 1/4 throttle imediately it will stay in first for a bit and shift smoothly.
