I am going into the dealer tomorrow morning and looking at going back to a BMW 5 Series all wheel drive. My ML500 has continual electrical issues, battery going dead for no reason, lights flashing, computers replaced, a myriad of software updates to correct this and that, recalls ... it's just too much for a $63K vehicle. Of course the dealer can fix it, give me a loaner to drive, etc. I'm just tired.
They are willing to give me $40K on trade. Says that's all it's worth to them. Fully loaded with 10K miles and almost a year old. A $23K mistake! Of course I will be going to another dealer here in Minneapolis and shop. Giving the same dealer another BMW purchase like all of the other BMW's and Mercedes I have purchased from them and they insult me with $40K. Probably all it's really worth. That's holding it's value! Time will tell ...
I have owned numerous Benz's, BMW's and Porsche's previously. Never have I ever gotten a vehicle from any German automaker so prone to issues and problems. Have read other's problems on the board and yes, I have had almost every one of them ...
Maybe the merger with Chrysler and the fact it's built in the USA contributes to the quality issues I have been experiencing. I don't know about Benz right now!

I feel your impatience because I'm in the same boat as you. Sell the darn thing and get hit hard $$ or keep it and probably experience more problems down the road??? I think I would sell it to relieve the "time to visit service paranoia" that affects me everyday.
i've had the same battery problem and they can't seem to fix it, but it hasn't done it in a while. As long as you have less than 18k and 2yrs you can lemon it and they'll give you every sent back, mine was 63k too i guess we're the ones with the damn battery problem, but i love my car too much to lemon it. It was my dream car and still is.

Get a lawyer and lemon it. Not doing so just sends a message to them that they're not doing any wrong. Most likely to avoid a lemon title, they'll buy it back from you and it will at most cost you attorney fees.
