after visiting the dealer over 20 times for different problems with my ML350 in a period of one year I have requested a buy back or new vehicle..
Yesterday I had a major safety problem with my car..I was driving on the highway at aprox 60 mph. Suddenly the car jumped into 3rd gear and reved up, dropped to 2nd and 1st with a time lapse of 5-7 sec. almost causing a major collision between 5+ cars. hopefully I was driving on the right side of the highway and was able to pull over. I restared the car and the problem was gone but it happened again 5 minutes after..I was aware of the problem so I drove carefully and managed to get home..I took the car to the dealer today and problems continued..I have contacted MBUSA and told them I was not going to drive the car anymore b/c of safety issues. The dealer told me a regional rep. was going to be there on monday..hopefully I can resolve this issue with no problems..
My car had alot of problems with srs, shocks, airbag, rattles, many recalls but I could manage that, a safety issue is something I will not tolerate.
please give me feedback on how to approach this matter and deal with MBUSA and the Dealership.
how old and how many miles are on the ML? tell the regional guy to drive it himself for a few dayz while u drive a new loaner, and if he's able to replicate the problem...you get to keep the loaner.
i think they'll just say it's a maintance issue and "we'll fix it under warranty".. but since it's not the same product defect that's failed 3times, it may not qualify for a lemon law
sounds like the tranny is going bad... just tell them u want out of the lease/purchase... if u take the depreciation on the ML they'll let u out.. if its a purchase just tell them to put u in a new one, but you'll have to pay taxes on the new car most likely during the registration process.. see if u can get the full credit for that (here in maryland that would cost u 5% of the car's value --> $2500smackers!!! yikes!!)
if they won't give u an out, tell them u want an EXTENDED warranty on the ML and free maintance for the remainder of ownership, if they believe in the ML it won't cost them to much and gives u piece of mind that future repairs are fully covered

No belittleing here. If you had read my response on the other forum you would see that. It just seems as if he is throwing mud at MB and this is NOT the way to negotiate what he wants to accomplish. Its like the guys that used to park their unwanted cars in front of dealerships with lemons stuck all over them. There are ways to get what you want done without stooping to these childish, low class methods.

Can you please specify where exactly am I throwing mud at MB? there is no reason for you to believe that.. and what are my childish low class methods you seem to imply?? you are way of topic here..I am very happy for you if you have a "perfect" ML500..that is just not my case
I know how you feel because I was in a similiar situation a few months ago. I finally got my buyback after writing a letter to the GM of the dealership and MBNA to demand a full refund or see them in court. Offcourse.., this was done after the vehicle experienced the same issue 3 times and they couldn't fix it. What drove me nuts was the service manager and head shop foreman tried to convince me that everything was fine when they knew it was a lemon. But I kept my cool because ultimately, these guys are only doing their jobs and you have to take the issue to upper management to get anything done. It's hard..., but my advice is to be patient and see what they say this time and if all fails, write them a letter to state your case. MBNA are not stupid because if they know you have a lemon case, they will move on it asap to avoid litigation.
Get a lawyer... most likely they'll settle out of court to avoid a lemon title on the car. It'll probably cost you attorney fees, but you'll get all your money back for the car.
