Thumbs down

Or maybe the guy does not work at the dealer anymore and that's why he has resorted to scamming people.

First let me say that you guys are great and a big help for me,a special thank you for the work to Google it and match up with the picture.
I had the same address found out but wasn't sure if it is him now after the pics I am.
I contacted an "online lawyer" just to know which way to go here are the answers.

1)You can report the individual to the police department in New York. You can sue him in small claims in either New York or Florida, but since he probably has no assets in Florida, you would be hard pressed to enforce any kind of judgment against him. The only way to get a judgment enforced is if the person has some sort of assets in the state, so your best bet is to file a small claims action in New York.

Q)Can I file a small claim in NY out of my home Florida,I mean online or per phone or how can I do that/

2)You should call the clerk's office for the small claims division in the county in which the defendant lives/does business. They should be able to fax you the paperwork you need to file a complaint as well as give you information about what you need to do to complete the filing and serve the defendant with the complaint.

Wow, I guess I am going to think twice about using paypal to do business. I thought they covered ALL transactions and would refund your money out of their own pockets and pursue the individual on their end. I guess not... : (

I agree with bandit, I am surprised at PayPal's response to you. I don't know if I feel as confident about Pay Pal now as I did a couple days ago. I guess there is no hedge against bad sellers.

Every mile a joy!

A good reason to tie your Paypal account to a credit card, not a bank account.

Dude man. This sucks. Sorry to hear. Any luck with the local PD? If not call the NYSP. New York State Police and report him. Too bad it wasnt thru USPS cause then you can call the Postal Inspectors and they will investigate crimes committed using the Postal Service.

Sorry to hear you got scammed. I know how it feels, it's aggravating, saddening, etc all at once. A year back the same thing happened to me, but I was luckier: only sent a 50% deposit, and when he stopped responding i threw up a paypal claim right away and got my money back one week later.

I guess that guy pulled out the $ from paypal fast, or you would've gotten it back too.

three weeks later, any new news or is it just "buyer beware" crap they keep feeding everyone?
"As stated in the PayPal User Agreement, recovery
of funds associated with a Buyer Complaint cannot be guaranteed."

OK, so once Paypal gets IT'S cut, who gives a fuck about the buyer?

"Please know that we will make our best effort to recover the funds in
question if they become available in the seller's account in the future and
will take appropriate action against the seller. Such action may include
issuing a warning, a temporary restriction, or terminating the account."

Yeah, right. The guy is going to all of a sudden put the money BACK...
Issue a WARNING? "Don't you go stealing people's money again, you bad boy..." BULLSHIT!

"We hope you understand our policy and that
it assures you that you are safe using PayPal."

I'm not feeling real "warm and fuzzy" right now, thanks!
