Just remember. Insurance companies are run by "bean counters." They'll do whatever they can to improve their bottom line. I like Shinigami's advice. It'll keep them on their toes.

That's too funny NewMB! I feel bad for jakepratt...sounds like he really wanted to be the first to have that '09 in his area. But hey I understand how he feels...I'm sure we all do. And about that advice, I agree with you and Shinigami. I really do have a pain in my neck and it was documented the day of the wreck in the emergency room, the day after at the chiropractor's office, and again today with my regular family physician. Yeah, I think I will call a lawyer, I wasn't going to at first but now that some of these pain killers are wearing off, I'm starting to think more clearly.

Always get X-rays taken if you are in an accident and mention that your neck and shoulders hurt. I'm not in favor of a person suing if they're not hurt but it gives you a little extra clout with the insurance company. Sometimes an injury problem can develope later.
I had a feeling that the car was a write-off when I saw the kink at the top of the windsheild frame. The firewall must have one hell of a dent in it. And if it does, there is really nothing you can do about it.
As the others have mentioned, the most important part is that you and your mom are walking after than accident - it amazes me that you escaped as lightly as you did.
I'm sure as heck not a "call the lawyer at the drop of a hat", but I will tell you than in general, when dealing with insurance companies, have a lawyer providing advice for you is just about a requirement these days. Above all, DO NOT sign any agreement with the insurance folks without have a lawyer look over it, particularly one that mentions your or your mom's health and current status.

Just a quick update about my car wreck. The car, as we all figured, was totaled to the tune of 45K +. The bodyshop stop counting at 45K. My insurance co paid off the car for the market value which was a little over 41K they also paid for my custom after market rims and tires. They paid the finance company and sent me the difference. MB of Anchorage tried to find a vehicle for me and told me that I would have to get a 2009 and I was okay with that as long as it was black with black interior with Vavona appearance package. I was so excited when they called me on Thursday to say that the car had arrived. On Friday (June 20th) I went down to take a look at it and was HORRIFIED! The exterior was beautiful I like the look of the SLK300 but the interior, in my opinion, was awful! The seats were beige and so were the door panels. I just did not like it. For some people this combination is okay, I guess, but I just wasn't feeling it and for 53K I should be happy with the whole car not just part of it. So I declined that vehicle and I explained that I could sacrifice the outside color but not the interior... after all, I will be inside the car not outside. So I took a peek at a Mars Red '08 and loved it immediately...the interior is almost a carbon copy of my Black '07 with the exception of the lumbar support, IPOD kit, and Nav unit (my '07 didn't have that). So that's what I have...yep I took the '08 over the '09 even though I would have been the first in Alaska to have an '09, I just couldn't get past those beige seats. The crazy thing is the '08 was more expensive than the '09 maybe it's the overpriced nav system and ipod kit???
And just like I mentioned before, I figured it would rain when I replaced my car...well sure enough, it has been raining since I picked it up and the forecast calls for rain at least until Thursday. That's Alaska for ya...it's either snowing or raining.
Oh...one other thing...my mom and I are doing well in fact my mom enjoyed the C300 that the dealer loaned me so much that she bought one. She got the 4matic with the sport package and loves it.

Hey Valkirk...as soon as it stops raining long enough for me to take some decent pictures I will post some. Hopefully I can do that this weekend.
And yeah...that guy is out and enrolled in a 60 in-house alcohol treatment facility. After his 60 days are up he is supposed to go back to jail until the trail in August. Yeah...right!!?? I'm not holding my breath for that to happen. It turns out that this guy had a total of 7 priors- 1- in Maine, 2- in Washington state, 1-in Oregon, 1- in West Virgina, and 2- in Alaska. This does not include the one with me and it does not include his driving under the influence of a controlled substance and possession conviction from 2005 here in Alaska. That's all proof that he won't stay put and also the fact that after he hit me, he tried to drive off, but he hit us so hard that he broke the axle of his full sized truck so he could only drive in circles (see the attached pic of his truck). I feel the same way that you do, he won't stop or the courts won't stop him until he actually kills someone and that's a sad and unfortunate thought.
It's quite simple. The law worldwide should be you get caught once driving under the influence of any substance, legal or not, you lose your licence for six months and are fined $5,000. If, after the first offense, you are caught a second time, you lose your licence indefinitely and are charged $10,000. If you take a life, you end up in solitary confinement for life without the possibility of parole. If anybody thinks this is harsh, it is because they are either a regular drunk/high driver or they have sympathy for them.
I remember reading about the DUI laws in Zaire in Africa. Kill someone while driving drunk and you face the firing squad and very quickly. I'm in favor of confiscating the vehicles of drunk drivers even if they don't own the car. If the local laws do not allow the car to actually be confiscated, at least it should be held for evidence for a few years.
