Fairness of 100-year prison sentence for mentally disabled offender questioned | Denton Record Chronicle | News for Denton County, Texas | Latest News

So this is the solution, Instead of providing adequate facilities for poor mentally ill and disabled, we throw them out on a street and if they do something violent, we incarcerate them for life. I think this judge, jury and the stupid lawyer who "defended" him deserve a 100 year sentence instead of this kid.
Pay attention to your own posted article:

"Young says he took Hart's mental condition into account after sentencing, flagging him for the "Mentally Retarded Offender Program," a special Texas prison unit that houses 930 inmates with mental disabilities. Hart arrived there this month.
Hart's father, Robert, said that while his son may look like a man, mentally, he's as young as his victim. He said the one silver lining in this case is that his son doesn't understand how dire his situation is."

That simply means he was not placed in a regular prison. This does not mean his 100 year prison sentence has been reduced or vacated.
Remember that this judge had an option to run the terms concurrently, but he deliberately ordered them run consecutively to conveniently get rid of this kid for good. But I bet that he "loves"
Jesus and sits in the front pew in his church every Sunday.

Oh, so you have a bitch with the Christians, too. Put it on another thread.

Once an inmate is adjudicated and turned over to the corrections department, unless the judge reserves some right to review, or an appeal is favorable, corrections pretty much gets to do what they want with the inmate.

Lifetime, or using another term, indeterminate, sentences for sex offenders have been in and out of favor since the late 60s with the recognition that such offenders recidivize at very high rates. I don't know Texas law, but I wager that 100 years was meant to give the perp an indeterminate sentence that could be adjusted to his supervision needs.

And, look, he's already in a special unit and you still gripe about his sentence.

You seem to epitomize the never happy liberal. You can really gripe when Texas want's him released to a halfway house in your neighborhood. Get back to us then--his sentence will have been greatly reduced as you wished.

Where did I say anything about anybody being a Christian and me having a problem with that. I have a problem with certain hypocritical believers though, who do exactly the opposite of what Jesus preached. As for this judge, I do not know anything about him, so the statement I made about him showing up in church and loving Jesus is obviously not serious.

I just found this thread. WOW.

I think the kids on the right need to be defending this guy. After reading the posts of bruce and bottom, I believe he is the future of the Republican Party. You have SO captured his essence.

I particularly liked "'tard" and "retard". That's impressive. I hope you don't know anyone with kids who might have handicaps. Wait...maybe you do. Or do you just not give a shit because that is part of that rightwing "balls" thing.

I also liked "a person with an IQ of less than 50, by definition, cannot live independently in free society and most probably should be institutionalized for life" and it's excellent transition from "institution" to "prison" so seamlessly.

What the guy did to the six year old would not be good. Although we have no clue what it was, apparently it was sufficient to get everyone's complete and undivided attention. Be that as it may, assigning 100 years to that, for any reason whatsoever is gross stupidity, whether it is in a prison or in an "institution for the criminally insane" [also an interesting leap]. Which ever institution he is in, he won't get the consideration he requires. He did NOTHING to get a 100 year sentence. [by the way, please reread the original article, he did NOT get charged with 5 counts of aggravated sexual assault as some keep writing]

It would appear that some of our left leaning liberal friends don't believe that the American court system has a right to sentence anyone with mental disabilities to time in detention for crimes they may have committed. Better yet those that don’t use the politically correct terminology should be shunned for their travesties, and that may be an even worse crime..
To hell with the victims, let’s protect the criminal; that makes us feel better about ourselves because we care more than you do……

Call the retard what you like, he’s still retarded, terminology doesn’t change anything, nor does it change what he was sentenced for. Granted we may not know what all the parameters might be, but the judge does, and it appears that he felt that the punishment fit the circumstances.
IF that is not the case, there is always the possibility that they can apply for an appeal isn’t there…..
Damn, just because some half wit gets a serious punishment for what APPEARS to be a very serious crime the bleeding hearts are all up in arms. Three things you need to remember:

(1) You don’t know for a fact that what the perp did wasn’t serious enough to warrant that sentence, the judge does.

(2) You don’t know what kind of care the perp will get once he’s incarcerated.

(3) You haven’t a clue if an appeal was filed or if one was/is even warranted.

Get a grip guys, as GS has pointed out repeatedly, we don’t know all the circumstances, but the judge does. IF he was wrong there are ways to make it right, but in the mean time some dangerous individual will be looked at by professionals with no ax to grind.

As to McB's comments, how do you know he didn't do something worthy of a 100 year sentence, were you there?

For heaven's sake, wake up people. We are dealing with a redneck small town in the middle of nowhere in Texas here. This sentence is an absolute abomination by any standard, especially given the fact that so many rich people guilty of similar crimes simply walk, either because they can pay off the family of the molested to drop the charges, or they hire a team of high priced lawyers who know how to get their client the most lenient plea bargain deal, which often results in a suspended sentence.

Most adult sex offenders with normal IQs get far more lenient sentences, even for repeated offenses.

You live in Florida, and yet you know all there is about this town in Texas, all there is about what happened, and how this should have been handled....

How about you fill the rest of us in, inquiring minds want to know...

I also lived in Texas for several years (not in Paris, TX, but I have a good idea what this place is all about).
