Screaming for justice can lead prosecutors to file unwarranted charges against innocent people. I seen such a case, here, in 1997 when Harold Pugh and his 11 year old son, Joey, was shot and killed at a boat ramp after being robbed. Their truck was stolen which was used in a bank robbery in Corinth Mississippi, which was later found burned. 2 college boys, one by the name of Ben Armstrong, was arrested and charged with capital murder which carried a death sentence. As they were led to jail after their arrest, citizens who were in close proximity to the suspects spat on them, calling them names unimaginable. Quite an understandable reaction being that two well liked members of the Colbert County community were supposedly murdered by these two. The prosecutor's office, under increased pressure by the community, had to arrest somebody so these boys were it. The evidence? Another college kid overheard them discussing what they would have done had they committed the crime. Sort of a role playing thing.
As more real evidence was unearthed and since the ABI was involved along with the FBI (crossed state lines), the boys were eventually released at the outrage of the family. The family still insisted the boys had something to do with it. After 5 other persons were finally arrested for the crime, no apology of any sorts were forthcoming to the two boys. Those arrested were Mark Moore, Michael Maxwell, Dale Ferguson, Keno Graham and Donald Risley. All were covicted of playing a role in the murders with two being sentenced to death.
To my knowledge, neither of the originally accused boys live here anymore and who could blame them. I knew the Armstrong boy. He had waited our table numerous times at a local eatery. I had commented to my wife that something just didn't feel right about this.
So, an example of overzealous prosecution shows WHY charges should be dropped if evidence isn't there to support these guys done it. Hell, they may have done the dragging and are guilty as hell. But you can't try someone with no evidence.
