I guess environmental groups suing the anointed one would be.

Reporting from Washington -- The Interior Department today let stand a Bush administration policy that bars the federal government from considering the effects of global warming on polar bears and other protected species, a move that upset environmentalists and cheered oil and gas companies.

The decision means the government cannot use the Endangered Species Act to reduce greenhouse gas emissions, even though Interior Secretary Ken Salazar explicitly blamed those emissions for the habitat erosion that landed the polar bear on the list of threatened species last year.

Environmental groups vowed to sue.

"The impacts of global warming are already being felt in the Arctic, and it poses a grave threat to polar bears and the entire ecosystem," said Andrew Wetzler, who directs the endangered species project for the Natural Resources Defense Council. "We need to use every tool at our disposal, including the Endangered Species Act. The rule endorsed today is illegal, and we will continue to fight it in court."

I like that they gave it a good review but don't like the outcome. I imagine the reasoning, at least from reading the Secretary's comments will provide a stepping stone for a global solution which would be the preferred solution anyway.
