(10-29) 17:26 PDT SAN FRANCISCO -- The family of a pregnant woman who was crushed inside a 15,000-pound press at a San Francisco printing plant sued her employer Wednesday, claiming that it failed to equip the machine with safety devices that would have prevented her death.

Margarita Mojica, 26, of Oakland was four months pregnant hen she became entangled in a creasing and cutting machine Jan. 29 at Digital Pre-Press International, or DPI, at 645 Mariposa St. on Potrero Hill.

The lawsuit filed on behalf of her husband and 6-year-old daughter in San Francisco Superior Court says the machine - which is used to cut graphic art products - suddenly engaged while Mojica and another employee were preparing it for a job.

State workplace safety regulators found that the cause of the accident was a failure to disconnect the machine from its power source. They agreed with Mojica's family that DPI had failed to outfit the machine with needed safeguards, and said the company had also failed to train employees to operate the machine safely.

The state said the company had committed seven serious safety violations and that its actions had led to the accident. It recommended $81,365 in fines. DPI is appealing each violation, said Paul Wolf, an attorney for the firm.

Wolf said the printing plant no longer uses the machine that crushed Mojica.

"It was a terrible accident," Wolf said. "We're still trying to figure out why it happened, and we have taken substantial steps to make sure this kind of thing never happens again."
