Lawsuit Claims Employee Said He Was Conducting 'Strip Test'
CHICAGO -- On her first visit to an ophthalmologist, one woman received a treatment that just didnâ€™t seem right -- toe licking.
For that licking, Roman Tesfaye filed suit against Evanston Ophthalmologists in Skokie, Dr. Tamara Wyse, and the convicted licker and ophthalmology employee Joseph Vernell Jr.
Tesfaye's first ophthalmology visit on July 13, 2007, started normally. While waiting for Wyse in an exam room, Vernell Jr. came into the room wearing surgical scrubs and dimmed the lights, the suit said.
Tesfaye shut her eyes and Vernell Jr. reclined her chair and put her legs onto another chair. Then she felt her right shoe fall off and felt something touch her toes several times. Tesfaye opened her eyes and immediately Vernell Jr. stood up and pulled his shirt down, the suit said.
Tesfaye then said, "Did you just lick my toes? You licked my toes."
"I'm sorry, I'm sorry, but I was checking your sugar level," Vernell Jr. replied.
Tesfaye reported the incident and asked the practice to call the police, the suit said.
Tesfay was convinced to stay and finish her exam. Wyse eventually came into the room and refused to discuss Vernell Jr. or the incident.
Vernell was subsequently arrested and charged with battery, and on July 23 he pleaded guilty, the suit said.
She still fears retaliation from Vernell Jr., and is suing for an unknown amount of money for negligent hiring, negligent retention, battery and negligent supervision.
Tesfaye claims it was an intentional infliction of emotional distress, and she still suffers discomfort and humiliation.
