You are splitting hairs on this one. Yes, the Fairness Doctrine in it's original 1949 form and codicils are gone however elements [as you point] out are still in place. Some are in the venue of the FCC where Fairness Doctrine was enforced and some are in the venue of the FEC.

Where the rate card issue come into play is pretty simple. If a person has a radio or TV program where they normally buy air time at X commercial rate for broadcast and then decide to become a political candidate then the station is required to charge them the same higher rate that they would charge any other candidate for a similar time slot. That goes whether it is a half hour or 1 minute spot. This came into play a few years ago when Pat Robertson ran for President. It is one of the reasons he moved off of broadcast and onto cable exclusively even though coverage at the time was much less in the cable market.

Where this comes into play with Oprah would be if she becomes an "agent" for Obama. At that point her broadcasts might be subject to a rate change. I say might because it would surely be challenged in court.

Where it comes into play with Rush is where he acts as a voice of a PAC and would have some governance by FEC and FCC if folks wanted to push it. Under the current Administration the FCC has refused to address it.

I just commented on the situation you brought up. And I commented with great detail and with all barrels. Not exactly how I would define a sidestep.

I would recommend you watch a rerun of either Tony Snow press conferences or Alberto Gonzales testimony to get a feel of the concept of sidestepping and diversion.

Your hatred toward Bill Clinton is obvious and I am sure everybody here realizes that by now. I don't like the guy any more than you do. However, your constant references of his failures on pre-9/11 shows your inability to see beyond your blind Party following. The current Administrations have had many opportunities to right the wrongs but, you know, the rest is history. There are just as many failures Bush is handing off to the next POTUS. Or should we start a list?
