Tough reading, but, after your post prompted me, I did read it. I had an involuntary nap along the way, but the ruling pertains to court procedural crap about who should be named in the motion by Padillia, and what court has jurisdiction. I think the dissenting Justice, Stevens, got it right. Instead the court basically turned a blind eye toward what it acknowledged was an issue of denying an American citizen his rights under the Constitution because of some procedural problems. Seems odd, where the issue of disregard for procedural issues concerning one man's Constitutional rights is ignored because his lawyer raised the questions in manner that did not meet with the procedure for filing such a claim.

In general, given the way the government is gathering information against the people it holds in Gitmo and other, secret, prisons, the information will be inadmissible in a US federal court. Which may mean these shitheads go free. All because our executive branch thought it was expedient and easier to just ignore their rights. Bad judgement, cover ups and in the end, our security is put at risk. Bad deal for Americans. Jim

So if you reviewed the case of Rummy vs Padilla, then you now know that since
22 May of 02 Padilla had counsel and was given due process in our court of law
almost from day one.

Go look into the access he had to legal representation when he was in the brig, solitary confinement, for 3 plus years, after he lost his petition to the government void the "enemy combatant" classification on a bunch of legal procedural blunders. I can't believe you think he was being given legal counsel when he was being held without charges. What legal counsel do you need under those circumstances? What would they do for you, and, given they have no purpose, how do they demand the right to see their "client?" Check into this man's daily life for the time he was held as an "enemy combatant." It seems you have not. Jim
