Of course they should be prosecuted, if it can be proven that 5,000,000 emails are actually missing or if it's an underated/overated figure. If the WH concedes 5,000,000, then there's probably more. As for criminal negligence, maybe, but it still has to be proven that the missing emails contained information that would result in criminal prosecution.

That is a separate issue and by no means criminal negligence. That is a coverup and coverups are not the result of negligence. No, in this case there is a rule that says records of activities in the White House cannot be deleted, erased or altered. They must be archived. And, now we have people doing White House business and circumventing the law that says the records of White House business cannnot be deleted, erased or altered, then claiming ignorance. If it is deemed negligence, it is criminal because a law was broken. If it was a single email, well, probably not a big deal. 5 or more MILLION? That is a real failure to do the minimum to comply with the law. Jim

Why? They are required by law to retain the email communications. If they failed in that responsibility, I call criminal negligence -- at best. Why is the content of the missing email messages relevant?

Who made that claim? When I screw up, say I get caught driving at 55 mph in a 40 mph zone, and claim it was a mistake I end up being fined and taking points on my license. Same if I break any other laws "inadvertently" as the law doesn't care. Nor should it.

Bush and company breaks the law, apparently regularly, with impunity and guys like you want to write it off as some priviledge that comes with the residence or office space address. Maybe that is how the government works in your new country, but we don't want that kind of government here. We want government by the people and for the people, we want accountability, honesty and truthfulness. We don't want people who screw up and then occupy the country's attention with coverups and lies. Jim
