Sucks for the seller but he has no legal foothold. Insurance company has all the rights to the car under law.

In past days when Insurance companies were "Mutuals", the profits of the insurance company would revert to all of the policy holders. Now, as a for profit company, they got lucky.

You have to side with the insurance company on this one. The original owner might try to set a precedent by claiming if he had known that the car would appreciate so greatly he would never have accepted the payoff, but I doubt that would get anywhere.

What's the deal with this paragraph?

"This must be a fun situation for them and a great change of pace from their normal daily routine of writing checks to cover losses. They're(the insurance company) actually going to make some money here, no matter how this turns out."

Nah -- he's OK -- he was paid and that's that. The guy who put the car on eBay is the one getting reamed. But I agree, the car belongs to the insurance company.
