Ken Starr's latest antics...

I'm so excited that my tax dollars are paid out for this kind of nonsense. To me it's a case that never should have been brought because the school officials should have kept their noses out of the student's business.


High court to get 'Bong Hits 4 Jesus' case?

JUNEAU, Alaska (AP) -- Former Whitewater special counsel Kenneth Starr petitioned the U.S. Supreme Court to take up Alaska's "Bong Hits 4 Jesus" case, a dispute involving a high school student, a banner and a tough school policy.

Starr, who gained national prominence while investigating former President Clinton's Whitewater land deal and relationship with Monica Lewinsky, filed the petition Monday on behalf of the Juneau School District in response to a March ruling by the 9th U.S. Circuit Court of Appeals.

The appeals court sided with a high school student who displayed a banner reading "Bong Hits 4 Jesus" during an Olympic torch relay in 2002. It ruled former Juneau-Douglas High School principal Deborah Morse violated former student Joseph Frederick's free speech rights.

The U.S. Supreme Court petition must receive a minimum of four of the nine justices' votes to be heard.

Frederick, then a senior, was off school property when he hoisted the banner but was suspended for violating the school's policy of promoting illegal substances at a school-sanctioned event.

"The principal's actions were so outrageous, basically leaving school grounds and punishing a student for a message that is not damaging to the school," said his attorney, Doug Mertz.

Superintendent Peggy Cowan said clarification is needed on the rights of administrators when it comes to disciplinary action of students who break the district's drug message policy.

"The district's decision to move forward is not disrespectful to the First Amendment or the rights of students," she said. "This is an important question about how the First Amendment applies to pro-drug messages in an educational setting."

Starr, of the Los Angeles-based firm Kirkland & Ellis, took the case pro bono.

The outcome could have implications on how student-conduct policies are enforced around the nation, said Eric Hagen, one of two other attorneys from Starr's office named on the petition.

"It makes it a little harder when teachers and principals in their daily duties might be subject to a damages lawsuit and be held personally liable," Hagen said.

That's interesting. Ken is the Dean of the Pepperdine Law School, in Malibu, down the road from where I am.

I don't think that your tax dollars are at risk here. He is doing the case pro bono.

I didn't realize that he had enough spare time to engage in private practice.

ummmm....actually I can read just fine. But the llast time I checked the US Courts were paid for by federal tax dollars...and the real waste is that the case had to be brought at all.

No one is questioning your reading ability. Why are we all so touchy all of the sudden?

The U.S. courts, and the judges and the attendant personnel are all paid for by Federal tax dollars.

But, those are fixed costs. Those costs don't change unless there is a major case, involving lots of court security, expert witnesses (paid for by the government in case of indigent parties i criminal cases), lots of overtime, etc.

In California, cases likew the OJ case and the Scott Peterson cases cost California taxpayers a ton of money.

Somehow I don't think that this case case will cost a lot of money to try.

But why is he bringing these types of cases, or any cases at all, when he is supposed to be the dean of a law school?

Interestingly enough, Ken Starr has also brought lawsuits, or joined lawsuits, on behalf of criminal defendants who have been, allegedly, wrongly accused and/or convicted.

Where, on the post that you quoted, do I express either support for what Ken Starr is doing, or criticism--other than to point the obvious that his job as Dean of the Pepperdine Law School should perhaps come first.

And how do you make the connection between my post about Ken Starr and my previously stated opnions about what the ACLU stands for--as of late anyway.

Please try to make the nexus.

If you can't, then I suggest that you keep your big yapper shut.

Or in language that you may more easily understand STFU.

You have serious anger issues, which are compounded by your inability to read even basic English.

What's the matter?

Not getting laid enough?

Welfare check did not arrive on time?

Whatever it is that seems to be troubling you so deeply, I think that you need help. May I perhaps suggest a few Jewish shrinks who would be more than happy to take your case pro bono?
