Let's see, she supports the ACLU with a fair amount of cash, then she hears a case brought to the court BY the ACLU................. Hmmmmmmmmmmm...
If there's no conflict, fine, but there is no way that anyone can say there is no possible APPEARANCE of conflict........... She could have, as the article stated, at least mentioned that fact. Seems to me she dug herself a hole whether or not it's a conflict...

Oh, and from the article, the judge did not give any money to the ACLU, she gave it to somebody, who gave it to the ACLU. I would also think given her appointment background, her ruling was a foregone conclusion. The real test on this issue is how the conservative appeals court will rule. I think they have no choice but to rule Bush's fascist power grab unconstitutional, because it so clearly violates the 4th Amendment. Even the conservatives will not be able to wiggle around it.

Ah, so now we are going to use the appearance of impropriety as the same as actual impropriety.

Do you want that same standard applied to your boys and girls? Can Scalia (for example) no longer be a member of the NRA? (if he is a member, I don't know) Should judges renounce their Bar membership--after all, lawyers are members of the Bar, too. Where does that crap end?

I'm sorry boys and girls, this is a stupid, petty concern.

The point that should interest you is not some perception of impropriety but whether the judge interpreted the law legally and fairly. Anybody have an opinion on that? What will happen on appeal? Will it go to the SC? If so, what happens there?
