That's where the public come into play. Gitmo is being shut down (as far as the public are concerned) because the public threw a fit. As misguided as the public usually are, they still do own this country and president. So, if the American people were to actually declare their feelings about the war being illegal, something might change.
People threw a fit about the military prisoners treatment. Even though normal interrogation tactics were being used, the public insisted that the military now stop their interrogation at "Pretty please with sugar, can we have the information?". It's one of the joys of living in a blissful nation of ignorance. Everyone wants protection, as long as they don't see the weapons that protect them. I digress
As long as MOST American's blindly rally behind whatever their told is truth (both sides of the political fence do this so don't even start), maybe this could be used as the catalyst to get the American people going.
Now another issue. As long as we start with ideas like taking the power back, accusations of treason, etc. you'd better damn well believe we (me) could start attracting unwanted attention from our friends at the Federal Bureau of Intimidation.
