Leona Helmsley 'vicious' dog lawsuit tossed

NEW YORK (AP) -- A Manhattan judge has thrown out a lawsuit filed against Leona Helmsley by one of her employees, who claimed the real estate queen's "fierce and vicious" pet dog, Trouble, bit her.
State Supreme Court Justice Marylin Diamond found that Zamfira Sfara, formerly the housekeeper in Helmsley's personal apartment in the Park Lane Hotel, was injured while doing her job and therefore was entitled only to the benefits she had collected under the Workers' Compensation Law.
The housekeeper said in papers filed a year ago in Manhattan's state Supreme Court that she was working in Helmsley's 46th-floor apartment overlooking Central Park South on November 26, 2004, when Trouble struck.
Sfara's court papers said she "was viciously attacked and bitten about her right hand" by the 6-year-old Maltese and suffered "severe and serious personal injuries."
The woman's court papers also said Helmsley knew the "dog had previously bitten others."
In a ruling made public Thursday, the judge said that because Sfara and Helmsley were "acting within the scope of their employment at the time of the injury, plaintiff's (Sfara's) exclusive remedy is through the Workers' Compensation Law and she is thus barred from maintaining a separate civil action against the defendant (Helmsley)."
Helmsley's spokesman, Howard Rubenstein, said his 84-year-old client was "pleased" with the court's ruling. He said she never thought the case had any legal merit.
Sfara's lawyer, Robert Garnsey, couldn't be reached for comment.
