I don't know the circumstances of the matter, but if the shooter were firing at a moving car from a moving car, he/she would have beaten some pretty stiff odds if the officer were actually hit; especially in a moving kill zone as small as would have been presented.
That said, and assuming the desired target was the officer's head, the grouping of rounds suggests that the shooter was uncomfortable with the recoil of his/her weapon. typically, when one anticipates the recoil, he/she will try to compensate in the opposite direction of the recoi, resulting in the shots fired being low and sometimes to the right (depending on the grip of the shooter).
It is interesting to me that a criminal had a relatively tight grouping at all (on the windshield) as it is unusual for a miscreant to learn and practice the art of shooting.
