Sure. You're going to lose, dude, because by charging this guy the government has essentially admitted that they do not have a right to detain him under some phony "enemy combatant" designation. Padilla now becomes like everyone else in this country, equal before the law. The government will have no more right to deny him a speedy trial than they did to deny him a trial in the first place.

Recall that earlier generations faced down fascism and communism not just with missiles and tanks, but with sturdy alliances and enduring convictions. They understood that our power alone cannot protect us, nor does it entitle us to do as we please. As I recall, they initially tied the Padilla case to another case in which a U.S. citizen was captured as an enemy combatant on foreign soil, to try to sneak it in under the rug, so to speak. 'Disgrace' is just about right.
