Advice Needed - Ticket in MA

Damn... The beast (me 2004 E55) gave me her first ticket yesterday and I need some advice from people in MA. I only moved here earlier this year so I am not sure what my options are for getting out of the ticket so please help!!

My first priority is to make sure I don't cop a ding on my insurance cost for next year. Second priority is to minimize any "demerit" points I might accrue on my drivers license and third priority is to get out of the cost.

I got done for doing 80 in 55mph zone on 128/95 southbound in Waltham. The fine is $250, and I also got a warning for "unsafe lane change x3" and for not having changed my TX license to MA license in 30 days of moving here!! I suppose it could have been worse but that was enough for one day. Plus the officer stood at the back door and spoke to me through the drivers window from there - like what... I'm gonna pull a gun on him or something :crazy:

It appears what caught his attention was primarily the alleged weaving between other cars to get past them, and as he caught up to me he purported to clock me at 80 (not via radar) and he checked "estimated" on the ticket as well.

So what is the best way to get out of the ticket? Can I do "driving school" in MA like I did once before in TX (not in the beast) so the violation doesn't appear on my record? If so, can I just nominate to do that? I could simply nominate to do it in TX without going to court, but it looks like I might have to go to court here just to get to try and do driving school instead of accepting the violation.

I have good defense that he "over-charged" me on this ticket. I wasn't doing unsafe lane changes. I was on the outside lane and someone was entering on a ramp and I moved in by one lane and then was blocked by a car in front of me and one on the left side, so I moved back out to the outside lane. And I seriously doubt I was doing 80... I might have been speeding a little, but he probably read his speedo as he accelerated from wherever he was (but somewhere behind me or entering a ramp) to 80mph to catch up to me, but that doesn't mean I was doing 80.

So thoughts and advice are appreciated!

Sorry no sympathy here. Pay the fine and stop driving like a lunatic.
I got popped in Illinois for speeding went to court and plead guilty, cuz' I was. $50 fine no record.......Honesty IS the best policy.

Can't win.
Pay up and get it over with, unless you thrive in negative energy prevalent in any litigious matter.

On the other hand:
Take AAA driver ed or something in that vein that is recognized by insurance companies and law enforcement. It will allow you for a insurance policy discount and reduce the points on your drivers licence (it's true in NY).

Check with MA state law and see if the same applies.

Do the driving school thing by all means – I took mine online and kept the points off of my record – kept the insurance the same as well.

Fax in to the magistrate a plea of not guilty and tell them to waive time for a speedy trial.
you well have a court date set up then send in a request for discovery.FIGHT IT

I couldn't agree more -- if you choose to break the law (and we all do now and then), just zip it and take it like a man when you get caught....

the laws very widely from state to state. Doing more than 20 over is considered wreckless driving...you can accumulate serious points for this.

Your best contact will be your insurance agent, he can share what the long term damage will be. Since your license is so new in MA, I will not even speculate...check with your insurance agent.

The $250 fine will look like chump change compared to potential insurance increases you will be subject to in following years.

you might get lucky by paying the fine and then quickly getting a Mass. license...
or go to court and try to get the thing reduced a bit.
tell them if you drive on 128 at 55mph you will be rearended forthwith.. and that is not lying and they know it.
