Curiously, the right-leaning posters are arguing that the lefties are blaming Bush for this outrageous ruling. But in reading the posts, I do not find Bush being blamed. What I do find is a general disgust with this latest example in the trend to curtail the rights of the citizenry in favor of corporate America. KV mentioned that this was the court that appointed Bush to the presidency, and this is true. But it was MS Fowler and tiggerfink who suggested that Bush was being blamed, when, in fact, he was not.
The idea that the left is blaming Bush for this one was brought up by two posters who are decidedly to the right of the political spectrum on this forum. They are trying to change the subject.
What subject? The majority of justices, save one, are the justices that voted AGAINST installing Bush (a ruling BTW, with which I disagreed).
The justices that voted against Bush (except one) voted FOR seizing private property. Put another way, the justices that favor state control of private property voted against Bush (save one).
Anything to help.
I agree with what you said about the Court--but the subject of the thread was the ruling about eminent domain. I was merely pointing out that no one had actually blamed Bush for this ruling, yet some posters were suggesting precisely that--just to stir the pot and sidetrack the discussion.
I agree with GermanStar--to those who truly value the Constitution, this Court is very hard to figure. The conservative judges, who presumably would champion state's rights, vote to overrule a state court and appoint Bush to the presidency. The liberal judges, who presumably would champion individual rights, vote to uphold corporate rights over individual rights. Go figure.
I figure the ruling is entirely consistent with wealth redistributing liberal/lefty/commie ideals. The root of this arguement for municipalities is tax base. If this were driven by capitalism, then the developers would have to increase the profit motive past the level of homeowner attachment to the desired property. This would yield the property for the developer and satisfactory compensation for the previous land owner.
This is driven by the socialist mentality relative to taxes. The home owners pay X amount per year. The perspevtive developed property would yield X+X. The governing body being of the socialist tax and spend mentality, uses a newly redefined 5th amendment to force the homeowners out for the better tax base. The developer is only the device the state uses to attain the greater annual revenues.
This is why the leftists on the supreme court identified with it....they are socialists (communist lite). From each according to his means, to each according to his needs.
Ultimately, this disscussion is moot in that there was no true property ownership in the US before. As long as the IRS can take your property to pay back taxes or folks have to sell thier property because the taxes increased beyond thier ability to pay, there is no real property ownership. The element of property taxes creates eternal indebtedness, therefore you don't own it.
Go take a political science course, Azimuth - this decision says that corporations and government can work together to create benefits for each other, even at the expense of individual property rights - a total standing on the head of the US Constitution, especially considering the fact that the idea of "corporations" didn't even exist at the time it was written. The melding of corporate and state power is FASCISM. If it was Socialism, it would simply be the state taking the land for state-owned enterprises, something which it has been able to do since before the word "socialism" was invented.
This is the new world taking shape - corporations and governments working hand in hand, with tons of cash passing between them. Small businesses, middle class land owners, private citizens, are now "second class". Democracy is ending in this country, replaced by the "Transactional State", where your congressmen vote the way their corporate sponsors tell them too, to hell with what you want. They will give you wars you don't want, take your land, flood the country with cheap labor so they don't have to pay you squat, and their paid off government lackeys won't do jack about it. Just look at the world around you.
Recall that earlier generations faced down fascism and communism not just with missiles and tanks, but with sturdy alliances and enduring convictions. They understood that our power alone cannot protect us, nor does it entitle us to do as we please. Instead, they knew that our power grows through its prudent use; our security emanates from the justness of our cause, the force of our example, the tempering qualities of humility and restraint.
