Ah, therein lies the rub (can I say "rub", given the sexual over tones of this thread?[:D]) We have headed down the path which leads away from original intent. We are experiencing the difficulties that naturally result. I'm with you (if I read your post right), let's get back to as close to the original constitution as possible. Will that be painful? yes. That is the consequence of straying from the rules of the game. Culpability lies with the straying, not the rules.

Regardless of whether the justice sodomizes his wife or if he uses hamsters in thier sexuality, it is not the proper thing to inquire about for political gain.

Actually, according to Scalia's thinking (as indicated in this article) he has no right to privacy according to the constitution, and therefore it IS appropriate to inquire regardless of the circumstances. It seems rather appropriate to treat Scalia according to his own principles. He seems quite comfortable laying down these rules for others, but is clearly not comfortable living by them himself. It serves to illustrate the hypocrisy of his position.

I find the man stupid. Given the great care the Founding Fathers put into individual rights, and the wording of the Bill of Rights, it is utterly stupid to then assume the FFs wanted us to have a government that could spy on us and restrict our liberties. Scalia advocates the position of the King, not the position of the Revolutionaries. The guy is an idiot. A consistent idiot as Koop points out, but an idiot none the less.
