Yeah, we should have judges decide all controversial issues. I don't know why we have this ol' messy democracy thang gettin' in the way.
Those damn pesky judges. Always running around and, you know, judging things.

So, Mr Plato, you agree that we don't need a democracy with those low-lifes mucking about, just smart judges to tell us how it ought to be.

Or maybe we could have a balance of power between judges and democracy and an executive. How should that balance play out? Perhaps the democrats and executive should be silent when the judges speak?

Yes, judges judging things that have been brought to court. The judiciary acting as an equal part of government. Doesn't quite fit with the imperial Congress and imperial executive. How inconvenient.

Not imperial courts?

Imperial congress is an oxymoron.

No, it isn't.

If, as you and your right wing buddies are so fond of squaking about, we are to live under "the rule of law" than you have to respect the decisions of those whose job it is to interpret the law.

That's the judges job, they interpret the law and they make the tough decisions. If you don't like the decisions, under the "rule of law" you don't get do overs. You don't pass ex post facto laws and you don't change the rules after the game is over.

-----------------------------------------------------Well stated, koop. What seems to be forgotten is that the judiciary has a responsibility to interpret the laws and to determine constitutionality. This case is a dispute--it is not the role of the Congress to handle individual disputes. That is for the courts. The husband says his wife would not have wanted to live in a vegetative state; her parents think otherwise. So now along comes the U.S. Congress, in a three-hour meeting, and proclaims that it knows more than the courts, which have spent months, perhaps years, hearing the merits of this case. The "rule of law" is a handy phrase for the neo-cons to use when they are proclaiming the requirements of democracy in Iraq--but it gets forgotten when the right-wing religious agenda needs to be served.

RE: Amerika: The New Fascist State

I was so sad to see the results last night. I have to admit that the Democrats are very dumb. If they stay home, there would not have been enough to make a quorum of 218 votes.

Moving forward, if I do not like the judgment of my local Judicial System, I will ask Congress to make a judgment for me.

RE: Amerika: The New Fascist State

I will accept the concept of judges judging things.
But what "things" and by what stanadard?
They take an oath to uphold the Constitution, yet some want to use laws from other countries, or their own agenda, as a basis to interpret US law. This should be impeachable as they have violated their oath. Actually any decision that is not based on US precedent and US Constitution should be thrown out. To be fair, one could also argue that members of congress and the executive branches have also violated the same oath.

Lets impeach everybody, and appoint KV, Shane and Bot to run the country as a tripart dictator. ( and they'd have to post all their policy discussions here, for our comment)

Its the Judges job to "INTERPRET" law...its NOT their place to make or write laws. Like the liberal loon Judges think they can do.
