now for a more measured approach. I stated earlier that the employer has a right to manipulate the situation based on the requirement to subsidize the eventual/possible ramifications of that behavior.
i later read a post that suggested that the risky behavior be compensated for by the individual involved the behavior. I'm for that. Parenthetically, didn't the employees who would not take the test, leave voluntarily? I'm not sure they were fired for being smokers, more accurately, they left rather than comply with company policy.
As to over weight workers, well if thier condition is not voluntary, they should be protected. If thier condition is voluntary but cannot be directly connect to poor performace or increased healthcare costs, they should be left alone. IMHO.
