A jury will focus more on the facts attributed to the delayed airbag deployment (both front seat occupants incurring critical frontal bodily injuries, a steering wheel pushed into the dashboard, a rear seat passenger lying in the middle of the vehicle, and documented rear-head injuries of only the front two occupants). The automatic downshift and the bracing of the accelerator claims are more so Mercedes can choose to improve their designs vs. a jury.
So wheres your case? the automatic downshift and the accelerator claims are pertinent facts in relation to the airbag deployment you were hurt by. Your whole case up to this post was that these factors created a specific situation with potential for bodily injury.
My point with the video and saying the body could go anywhere, is that the WAY the rear passenger went forward is unknown. If the outside passenger side of your seat is bent, how are we sure that the rear passenger was not way over on the passenger side of the car leaning against the door? If he were there, would he not hit the outside passenger side of the seat on the way up?
Do you know where he was sitting for sure?
Could I just as easily make the case that the rear passenger on his way forward, damaged your seat on the outside, and did the damage to the back of your head as well? How would you disprove this theory? There are scores of precedents of unbelted rear passengers hurting and killing front passengers.
You are asking for justice, and i feel for you, but reading back through this thread, your case does not convince me that it was anything but a tragedy and that you personally have been put through the wringer and are now extremely bitter. I WANT to agree with you, but if what you've posted represents most of the evidence you have, its clear why no lawyer would take this case, its too weak to win.
EDIT- As a further comment after reading through the thread again, every time you post, you make the case against the AMG driver stronger and stronger in my mind.
From what I understand, you were passing a car 1/4 mile before the accident, he was on the cell phone at some time before. From what you post, it was an intense personal matter of a nature that reduced him to tears. After that, you go on to discuss that he reacted perfectly naturally driving a fast car fast around curves, as you would have done. All of this information indicates that he was distracted, upset, driving fast, passing, not wearing his seatbelt, ect. Your posts alone make a spectacular case for driver error causing the accident, not a torque lunge.
You also make several comments estimating speed of both vehicles and then drawing conclusions from that. This is something that you cannot know, that the police cannot know, that no one knows. Furthermore, everyone would KNOW that you cannot know this information. All speed estimates are just that, speed estimates based on the level of vehicular destruction.
