It is quite simple. The any car with an airbag needs to be rolling at a certain speed and hit within a certain angle for them to deploy. If you are stopped, or nearly stopped, the vehicles computer thinks the car is not rolling fast enough for anyone to benefit from the airbag. The only airbags that will deploy with the ignition on and the vehicle at a dead stop is the side and curtain airbags because you do not have to be rolling to get hit from the side.

To answer your question-Yes you can sue anybody in our society in the US. Will you win-that would have to be answered by a top Attorney and would depend on how much money you are willing to spend to win. (would cost more then just buying a new car more then likely)

I would say do not bit the arm that protects you-which it sounds like this car did in your situation.

there must be a sound reason why what happened happened. There seems to always be with a Mercedes Benz.

Unfortunately, it will be free for elite to get an attorney and he'll probably end up filing a suit anyway. His description of the accident is one of the most incoherent things I've ever read. First he got hit, then he hit someone, then he was almost stopped when he got hit, then he was moving when he hit someone. I hope he's punch drunk still from the accident.

Here's what will happen- he'll get an ambulance chaser attorney, the attorney will file a frivolous lawsuit, MB will inspect the car and say the car performed exactly how it was supposed to perform, ambulance chaser will contest, MB will pay him $10 or $15 grand to go away. Case closed.

It's sad that he's going to get something when he wasn't hurt and MB did what it was supposed to do- keep him alive and safe in an accident.

Well, I have a different slant on things, I think WE should take a vote to see if this is the DUMBEST thread ever on this SITE, How could someone be STUPID ENOUGH to want to file a suit against a Co. that kept them from getting hurt??? I think that we have ALL been tricked by some SMARTA$$ LITTLE PRICK!!!! NO ADULT COULD POSSIBLY BE THIS STUPID!!!
