Syncing a keyless key fob

I found a key fob from my 2008 E-350 which I traded in, can it be synced to the 2012 E-350 both keys look identical?

nope, at least not legally in USA.
Doable in other countries, but ignition switch need to be removed for the procedure.

The part of the key and the car's drive authorization have to basically be hacked and have the RFID chip in the working fob read and then cloned to a new one in the key you have from your 2008.
That kind of tampering is a violation of the DCMA. You can google around probably find somebody to do it. By that time do you trust that shady character to know where you live and not be part of some sort of car theft ring. It is risky and really not that much cheaper than getting a key a at a dealer. We get them for under $220 here and I think Kajtek found a place that is even cheaper than that.

I know characters who do it in USA and I would not consider him shady.
He knows where I live btw. Still with MBUSA policy, that has to be done under the table.
Anyway, it is all matter of cost and risk.
Last key I bought from dealer cost me $162 and I've got it in 2 days. Call around as having 6 dealers withing 50 miles radius, I was getting $390 quotes as well.
Now, even I "know right people" they don't live close and by the time I find good key on ebay and arrange programming, the $162 starts looking better.

Yes, please drill down on the DCMA and show its applicability to this situation. Also a citation to the appropriate provision of the United States code would be appreciated. Sometimes assumptions made from "internet knowledge" are not sufficient.
