oefvetw124lover, this is really a good idea, I will talk to them like you advised.

But if they tell me the problem get fixed already, and that was not a big problem, for instance, just program problem . Can I still request a replacement of the SL?

if it was me, I would want a replacement car as the current car has already lost my confidence.
however, you must do what works for you.
I am amazed that you are having these issues in a 85K dollar car !

You guys aren't living in reality.

They aren't going to give you a new $90,000 car because it's stalling at stops. This is why cars have warranties and people to fix them. If there's an issue, you take the car to the dealer and they fix it. Take their service loaner and let them do their thing.

And if you are so concerned about resale value you shouldn't of bought a car that will depreciate so fast it'll make your spin. It'll be worth $65,000 in three years no matter what.

You going in and making outrageous demands like asking for a new car is a good way to have that dealer roll their eyes every time you pull on their lot.

If he has had the car for less than 5 days the dealership could give him another one.
here is the deal. once the loans are finalized, the Dealership doesnt care.
because it becomes are relationship between the loan holder and the loanee.
The Timing is the key.
I was under the impression that he recently got the car and it is manifesting all these issues.

but the fact the car has all these issues in its first year of use is truly saddening.

Thank you for being so considerate oefvetw124lover. I also every expect a new SL could have these problems. I never bring problems to the others, and I don't want the dealer and sales representative to have hard time. The new car order takes a few months, asking them for a loaner while waiting the delivery of the replacement also seems not realistic...

But exactly like what you said, I totally lost the confidence on that specific car.
I really what it to be replaced....

how long have you had the car ?
did you get it yesterday ? a week ago ?
Once the contracts / loans are signed it becomes an agreement with you and the loan people.

I picked up Friday evening at 7, then I drive it back to the service department at 1pm Saturday. And all of the document get signed when I pick up the car.

so harv and oefvetw124lover..... so that replacement is not realistic right ...? Do you think calling mbusa is helpful?

They are going to stick to the lemon laws of NY. You can ask for a new car, but they will not budge until one or more of the criteria are met for the NY lemon laws.

You have have the right to complain to MBUSA and the dealer(I would be complaing at this point also). Harv81 is correct that expected them to just fold and give you a new replacement is not going to happen.

To OP have the car check by dealership and go from there.
Maybe it is 3 minutes fix?
The lemon laws were not written to give new car to everybody who forgot to close fuel cap or something in this line.

HI Kajtek, many thanks for the reply. SO you think that this could be a rather simple problem?

As a said in the origin post, I do not have any idea if this is normal or subtle problem for new car. I wish it can be solved by just a a program update. I totally never have this issue before.
And I did some home work, search this online, seems some ppl having the same problem have this stall issue for a long time, and never get fully solved, some other have problem with the engine. I admit that the posts are sometimes post selected, that those who have subtle problem will not post the issue online.

I also hope this is nothing serious, as I really want to have nice drive in the car instead of spending half an year waiting for new cars.
