too much oil

I have a 2001 c320...i got an oil change a few days ago and today "too much oil" light went on. I called the mechanic and he said that he put 9qt of oil even though the car takes 8.2-8.5 because the car has a slight leak. Can this damage the engine? Is it serious?

Also, my fuel gage doesn't read anymore. i think the censor is faulty. does anyone know how much it would cost to fix it? is it one or two censors?

it doesnt have a dip stick. it reads it electronically when the engine is off. i just checked it and it says the level is ok... (doesnt say how much oil it has)

but the light is probably going to go off sometime when i drive the car tomorrow...

You can also get the exact amount of oil in the engine in dyno mode.

For my 2004 CLK320, these are the instructions to go to dyno mode:
1. Make sure the default mode in your cluster is set to temp.
(Close your door and windows supposedly)
2. Turn to ignition 1, within 2 seconds, press the dash reset handle 3 consecutive times till you hear a beep.

If you get into the dyno mode successfully, scroll till you see the oil level. Start the car and you will the oil level goes down as the oil get circulated to the engine.

Mine started at 7.9 - 9.0 L and and settled around 6.1-6.2 L while driving.
