2005 E320 CDI Transmission Slipping

I have a 2005 E320 CDI with 165K. I have just started to notice that the transmission is slipping between 3-4 gear. The car increases 100rpm, before settling into 4th. I took it to the dealership, and they told me it was only a matter of time before it got worse and would require a new transmission. I have had all of the regular service done, EXCEPT the transmission fluid changes. So it appears that I have done this to myself. The dealership advised me not to change the fluid at this point, because it might make it worse.

I have several questions that I hope someone could help me with.

1. Has anyone had this problem with this model. I have read that there were issues in older models with glycol leaking into the transmission case..is this happening to 2005 models as well?

2. I just started to notice this the day after I changed out the main battery in the trunk...I know its a stretch, but could it be related? Could it have something to do with the adaptive transmission memory?

3. I am NOT a fan of "Fix in a bottle" products, but has anyone had any experience with them. Lucas Oil or Seafoam?

Your car is W211 body and you might find better response in W211 section.
The "don't change old ATF" story is traditional story from mechanics trying to avoid potential liability issue.
It is understandable that mechanics don't want to touch old transmissions showing problems already in the fear that after fluid change the transmission might completely fail because of age/wear and the owners will be after them since they did the last job.
We do have lot of discussions on the the subject in W210 section, where older cars do have the issue coming more and more.
Common advise is to do transmission service anyway. New fluid can not damage the transmission, while there is still a chance that cleaning the dirt from the pan might help.

Agree, service the transmission and send a sample of the old ATF to a lab for analysis. I doubt the battery change has anything to do with it. When you mentioned Seafoam and Lucas are you considering those for the transmission? They won't do any damage to the fuel system but I wouldn't add anything to the ATF. I never add anything to the motor oil either.
