Car left to a Garage - damaged - Colin Ferns
Have left my car to local Mercedes specialist called Collin Ferns (Surrey) as we arranged that they will sell it on my behalf.
I left an immaculate Mercedes S430, it was clean with not a single scratch or marks and was promised that the car will be kept in their warehouse not outside.
The car didn't sell after 6 weeks so I came to pick it up and found my car so dirty it was brown (usually its blue), the passenger windows was cracked (it has double glazing luckily) and there was scratches on the front bumper and wheel arches. In addition the battery was flat. Apparently the car was left parked near a house destruction plan not in the warehouse.
When a brought the car we inspected it all around but nothing was made in writing as I use this garage for long time I thought that I could trust them.
The only thing I was told by the garage owner is to ask my insurance to pay for the glass but as there is an excess I won't do it so I left the car there but don't see what I can do to get all these damages fixed before I collect it.
I have not taken any pictures because I was supposed to collect the car that day and was not informed of any damage or issues, I think they just dumped the car in the street without event trying to sell it.
I think that I should try to take a tape recorder on Monday and confront the garage manager, I will have evidence as he may say things....
I don't want to take the car back until they fix it as otherwise if the car leave their garage I am really losing all my rights.
Is any of you ever claimed money back in court?
I have an email that I wrote after I left the car where I remind them that the car need to be kept in the warehouse and that it was damage free (no reply to this email bust it still something written).
By the way my car is a Mercedes S430 so any repair are very expensive indeed.
