Catalytic Converter on older ML320

My wife has been driving her 2000 ML320 with no problems since we bought it used in 2007. Recently, over the course of about 20 miles, it went from sounding normal to sounding like a tank. I took it in to a Midas shop and was shown where the weld on the catalytic converter had seperated. I couldn't imagine what would cause the weld to give way until I started looking for online answers and came across the recall notice from 2005 regarding this specific issue. The car was inspected in 2005 and the previous owner got a clean bill of health on the cat at that time. However, now that the weld has actually given way, I'm being told that because it was inspected previously, there is nothing that they are responsible for at this time.

Here's my question. I can't think of any engine problem that would cause a weld on a cat converter to seperate. Am I missing something? If it's a result of a defective part, as Mercedes as much as admitted with their recall, shouldn't it be replaced per that recall?

You're missing the fact the part is almost 11 years old.

It was built for meeting the Federally required 8 yr or 80K mile (whichever first) warranty, which it did. There is NOT a lifetime warranty on this part.

Some of catalics had recalls and following 10 years old warranty.
Check with the dealer just in case.
If the catalic gets clogged, it builds high pressure and separating aged weld is easy to figure out result.

I have owned 2 w163's and I have had problems with the cats on both. Here are instructions on changing the drivers side cat. The passenger side is easier:
