No court would consider your $2k pure damages or a "write-off" - you had the use of the car, which has value, likely to be valued by a court at about $2k. I don't see any fraud on their part, and if there was it would be extremely hard to prove. They are going to paint themselves as a victim too, one that made it right when they found out about the problem. Lack of skill in identifying a previously damaged car is not unlawful.
