I don't know the law but isn't it the responsibility of the owner to keep his/her car in proper running condition? The mere fact he was doing almost 30mph over the limit would raise a red flag. I truly hope he gets off and if he does, please let us in on how he did it.

Either get the speedo fixed or show that it is in process. The cost of the speedo repair might be as much as the ticket BUT the points and insurance increase and overhang of points for three years is much more.

I don't know about NC, but Georgia requires a vehcile to have an operating speedometer. Now that being said, as others have mentioned, have it fixed, take the paperwork and request a pre-trial conference with the prosecutor (which in a small jurisdiction may even be the officer himself). Show them that is has been fixed, ask if they can reduce the speed or help keep it off the driving record. You will probably find that they are very willing. This is exactly what the attorney will do, if one is hired.

Also, tell him to ask the court clerk if they have a ticket deferral program. If he has a clean record, he may be able to defer the ticket, which means it won't show up on his record for insurance or for points towards license suspension. He'll still have to pay the fine, but the ticket disappears. Some communities allow it, some don't.

I don't think the "broken speedometer" defense will help much when he's that far over. It's at the discretion of the judge, and he/she may not see that as a valid excuse for speeding.
