You didn't say who at that dealer told you they would not replace it. If he/she was an underling, it sounds like you will need to move upward in the chain of command. If you need to, I'd advise you to go all the way up to the owner.
If your car was under an M-B warranty, you could go further up the ladder to the M-B regional rep and that might still be possible. Hopefully, you can resolve this long before a drastic step like that.
