Question Warranty issues with rust (2002 c230 Kompressor) :(

Hi,
I didn't find anything in the search, so here is my question:

I just bought a 2002 C230 Kompressor with less than 28,000 miles on it and already love the car. The fly to the ointment is I found some rust on the bonnet and both the b-struts (between front and rear window) and on the hood (near left windshield wiper and twice at the front, over the lights, one of the only visible if hood is open). Since the car is under warranty until end of June I went to the local dealership today to show them this. After about an hour's inspection they came back with the following verdict:
-
  • rust on the bonnet (on all three accounts!) was caused by object impact and the wrongly repainted.
  • rust on the b-struts was also caused by object impact

Thus, no warranty.

I have pictures of the rusty bits (actually, it's mostly the paint beginning to bloom) and they didn't even wipe the dirt away carefully to inspect the paintjob!

Whom can I appeal to, as I do not want to accept this like it is?
Your ideas and suggestions are greatly appreciated.

this sucks..... wow a newer Benz with rust issues - that's new to me.

Unfortunatly i have to agree with dealership.

Most likely your car was in accident and was repainted. May be it sat sometime which chipped paint. Whoever repainted it - didn't do a proper job - as result it started to rust. You can't ask MB to warranty improper repairs done by somebody else.
