Timely topic as the wife was rear ended in our '97 E 300 D last night. Damage seems limited to the bumper area and the trunk seems to close like it did, but it did a number on the bumper cover. I would think that the diminished value would be much more of a problem on a new car that on the old ones that I prefer, but it is real, and just a risk one takes when he gets on the road with humans.

Back to the original question: how to recoup money from an insurance company when they say this is what we will pay and you say my losses are more than that.

Short answer is you must sue the driver who hit you. If the insurance company offers you $x and that does not seem right or fair - get your facts straight. what the actual damage was, all the value lost, any car rental while your car was repaired- also the real value of your car an appraisal will help, ads for comparable cars. If it's under 5000 (check your state laws). Use small claims court. If it's more you will have to hire a lawyer who will charge you a % of your claim.

But that is the only way. The other insurance company owes you nothing. If you win they will owe the other guy what he had to pay you.

I would get an attorney and report the accident against your own insurance. I was hit and run by a drunk contractor while my car was parked last November. Liberty mutual has been dicking me about and low balled the estimate on the payout. Body shop said their estimate was inadequate by at least $3k. Three months of their bull crap, threatening the general contractor with legal action, and police reports, I called my carrier and the car was in the shop in ten days.

Three weeks ago, I was a witness to an accident. Guilty party was covered by Liberty. They hire morons to deal with claims. I got into a yelling match with the brain dead idiot on the phone when she implied I was lying about what happened. Same story as the other witnesses gave, and these low lifes were working hard to screw people out of getting made whole.
