Mercedes dealer - Con artist

Hey guys,
I'm new to this forum, and the only reason i joined this is to complain about a mercedes dealer in Australia. I don't think i should give the exact dealer, but i'm tempted to..
A respected person that i know, got ripped off by mercedes to say it upfront...
I don't know the exact details on everything but i know he wasn't treated with respect nor got what he wanted.

Anyway what happen was, he brought a brand new 2004 series mercedes, i don't really follow mercedes,but i know it competes with the bmw 3-series compact?
anyway he signed the contract to get the car, and he picked up the car. He then realised that mercedes had gave him a second hand 2002 spec car!! they had altered the contract somehow... i'm not sure what he done, but i think he went to court of some sort and loss the case and now he cant' do anything about it.. So his stuck with a old car where he paid for a brand new spec mercedes, and he cant' even sit in the car for no more than 30mins cause the car is soo uncomfortable...

i know this story sounds sketcy and all, and doesn't sound like a real story with the contract change..
But the guy that brought it, is a great bloke and i trust his every word..
Well when i first heard it, i thought no way that could of happen, but the facts are there, his got a 2002 spec car in his garage now, and paid for a 2004 car.. His lost a couple of grand over this...
anyway, I dont know if this has every happened before, but i guess you can never be so sure about car dealers

Some good advice to you friend.

Always read the fine print.
Always get a receipt with clear info
on what it is for.

If the contract states "a 2004 whatever
mercedes" then I don't see how he could
be sold a 2002 MB.
Now if the contract states "a 2002 whatever
mercedes" then that is a different story

What does the contract state?
Did the dealer change it before or
after your friend signed it?

Does your friend have any proof of what
the cost was for the "2004"?
Advertisement or the likes?

One other route to go is to call MB Australia
and report this to them and have them look
into this dealer.
If they done it to him they most likely have
done it to others too.
